If it is an accident injury case in RI or Mass, then the former attorney will still have to be paid for his or her time on your case. Always insist that any new lawyer that takes your injury/accident case pays the prior attorney out of his or her fee. That is, your fee should NEVER be more than 33% of the settlement or judgment; regardless of two attorneys.
