<p>Governor Charlie Baker continues his push to crack down on drugged driving laws in Massachusetts. Baker’s legislation attempts to close many of the loopholes that allow motorists, such as the driver that killed State Trooper Thomas Cardy, to go free of penalty for driving under the influence of certain drugs and causing injury or death. Baker’s proposal, originally filed in 2019, has been refiled and named after Cardy, who was killed in 2016 during a traffic stop by a medical marijuana patient who was convicted of involuntary manslaughter, but acquitted of driving under the influence of cannabis. While breathalyzers provide reliable blood alcohol content (BAC) levels, accurately measuring the level of other substances, like marijuana, in a driver’s body proves to be more difficult, and controversial.</p>


<p><strong>Drugged Driving Bill in MA</strong></p>


<p>The aim of Governor Baker’s drugged driving bill is to close gaps in the current laws that can allow motorists impaired by drugs such as cannabis, prescription medications, and other drugs, to be held unaccountable for these offenses. The <a href="https://www.bostonherald.com/2021/12/14/police-driving-groups-back-baker-bill-to-crack-down-on-drugged-driving/" rel="noopener noreferrer" target="_blank">proposal</a> seeks to expand the 12-step drug recognition expert (DRE) training for police officers to identify whether a person is impaired and if so, by what substances. The DRE process includes specialized observations of the motorist as well as measurements of heart rate, temperature, and blood pressure. The bill would also subject suspected drivers to a blood test for THC (the primary active ingredient in marijuana) and require Massachusetts courts to recognize the DRE trained police officers as experts.
<strong>Does Legal Marijuana Use Result in More Auto Accidents?</strong></p>


<p>While marijuana usage was made legal in Massachusetts in 2016, whether or not its legalization has contributed to an increase in auto accidents is a hot topic.  <a href="https://www.iihs.org/news/detail/crash-rates-jump-in-wake-of-marijuana-legalization-new-studies-show" rel="noopener noreferrer" target="_blank">Studies</a> by the Insurance Institute for Highway Safety (IIHS) found that auto accidents increased in states that eased up on their recreational marijuana laws compared to those states where marijuana remained illegal. (The particular studies cited did not involve Massachusetts.) Accidents involving injuries rose by 6% while those that ended up in death also rose by 4%. The amount of accident claims filed following the legalization of marijuana has increased in the range of 3% to 21% depending on the state in question. When it comes to whether the actual ingestion of marijuana is causing this increase, the results are more mixed. Studies found that those under the influence of marijuana have slower reaction times and are more likely to drive into other lanes unintentionally, while other studies found that marijuana users often drive slower and remain farther away from other vehicles.</p>


<p>The difficulty in conclusively analyzing the effects of marijuana on drivers is that there are significantly less reliable drug tests performed on the road compared to alcohol exams. When a driver is using both substances, it can be difficult to pinpoint which one is causing the symptoms in question. In addition, the reliability of blood tests for THC has been taken into question by those opposed by the bill.</p>


<p><strong>Marijuana Use & Car Accidents</strong></p>


<p>Still debatable, one potential theory for why legal recreational marijuana use has increased accident rates in some states is that people are more likely to drink <a href="/personal-injury/car-accidents/types-of-car-accidents/drunk-driving-accidents/" rel="noopener" target="_blank">alcohol</a> at the same time as using drugs such as marijuana, but future studies are needed to test this theory. An analysis based on self-reporting found that joint use of marijuana and alcohol has increased according to the AAA Foundation, which also found those who engaged in both of these activities at the same time were more likely to get behind the wheel of a car and drive recklessly than a driver consuming alcohol only. The analysis also stated that drivers using both substances at once were also 20% more likely to speed and 16% more likely to drive through red lights as opposed to drivers only under the influence of alcohol. They also were 24% more likely to act <a href="/personal-injury/car-accidents/types-of-car-accidents/aggressive-driving-accident-attorney-in-ri/" rel="noopener" target="_blank">aggressively</a> on the roadways and 19% more likely to <a href="/personal-injury/car-accidents/types-of-car-accidents/texting-driving/" rel="noopener" target="_blank">text</a> at the same time as operating their vehicles.</p>

<p>Motor vehicle accidents involving pedestrians have been on a sharp rise over the past decade throughout the country. In fact, pedestrian fatalities have increased 35% since 2008, compared to a 6% decrease in all other motor vehicle crashes in the same period. A recent report by the Governors Highway Safety Association estimates 6,227 pedestrians were killed on U.S. roads in 2018. Based on preliminary 2018 data, this is the highest number of pedestrian deaths due to <a href="/personal-injury/car-accidents/" target="_blank" rel="noopener noreferrer">car accidents</a> since 1990. Why are pedestrians in Rhode Island and the U.S. at such a high risk for getting killed by a car? Automobiles are safer than ever with the latest technology and innovative safety features including sensors that tell a driver when a person or another vehicle is too close. <strong>Graduated Drivers Licensing (GDL) Policy for New Rhode Island Drivers</strong></p>


<p>Rhode Island is one of a number of states with a graduated drivers licensing policy (GDL). <a href="https://www.dmv.org/ri-rhode-island/teen-drivers.php" rel="noopener noreferrer" target="_blank">Graduated drivers licensing</a> allows a new teen driver to gain experience by phasing in driving privileges prior to reaching a full privileged driver’s license.  During the process, they become more acclimated to operating a vehicle, varying road conditions, and safety rules. Phasing in driving privileges introduces new vehicle operators to the regular automobile population in a low-risk way that helps to protect others on the road, as well as themselves. A Rhode Island driver’s permit may be issued to a Rhode Island resident who is at least 16 years old, but less than 18 years old and has completed a certified driver education course and passed the DMV written test. The permit must be held for at least a period of six months during which time the driver may operate a vehicle only when accompanied by an adult aged 21 or older in the front seat with a valid driver’s license for at least five years.  Permit holders must complete 50 hours of supervised driving, with 10 hours completed at night. After passing a road test, a limited provisional license is issued with restrictions that the teen can drive unsupervised, except for between 1am and 5am. The driver may not drive with more than one passenger under the age of 21 for the first 12 months. A full operators license may be issued at age 17 and 6 months assuming the provisional license has been held for at least 12 months and no moving or seat belt violations have been issued in the past six months.</p>

<p>Since the legalization of marijuana movement began in the U.S., health and safety experts have been trying to measure the potential impact it would have on traffic accidents. Without ample past reliable data to go off, much of the results so far have been inconsistent. However, according to a new set of studies by the Insurance Institute for Highway Safety’s (IIHS) Highway Loss Data Institute, <a href="https://www.iihs.org/iihs/news/desktopnews/crashes-rise-in-first-states-to-begin-legalized-retail-sales-of-recreational-marijuana" rel="noopener noreferrer" target="_blank">an increase of up to 6 percent in the number of highway crashes</a> has been found in four states where the recreational use of marijuana is legalized. As Providence personal injury lawyers, Tapalian Law feels any uptick in car crashes is reason to sit up and take notice. Our car accident lawyers see clients everyday who suffer from serious injuries incurred in an auto accident. While the latest reports cannot yet prove a direct risk caused by the use of marijuana among vehicle operators, there is a rising trend in these states and any upsurge in <a href="/personal-injury/car-accidents/" rel="noopener" target="_blank">car crashes</a> is cause for attention. At this time it is a challenge to accurately test drivers to determine if they are under the influence of THC, the active ingredient in marijuana. Without this hard proof, much more research needs to be done to explore marijuana use and its relationship to vehicle crashes. After this Tuesday’s election, <a href="https://www.businessinsider.com/legal-marijuana-states-2018-1" rel="noopener noreferrer" target="_blank">10 states and Washington D.C. have now legalized marijuana for recreational use</a> for adults over the age of 21. Rhode Island has not legalized marijuana for recreational use. Medical marijuana is legalized in 33 states, including Rhode Island.</p>


<p><strong>Results of IIHS Study Linking Legalized Marijuana to Car Crashes</strong></p>


<p>The <a href="https://www.iihs.org/iihs/news/desktopnews/crashes-rise-in-first-states-to-begin-legalized-retail-sales-of-recreational-marijuana" rel="noopener noreferrer" target="_blank">IIHS studies</a> used police reports and insurance claims to determine auto crashes rose between 5.2% and 6% in states with legalized recreational marijuana, in comparison to neighboring states where marijuana use is illegal. Highway crash data from surrounding states was also compared in an attempt to control for factors like weather and economy. One disturbing find from the study is that while most <a href="/personal-injury/car-accidents/types-of-car-accidents/drunk-driving-accidents/" rel="noopener" target="_blank">drivers under the influence of alcohol</a> are driving alone or with other adults, approximately 14% of those confirmed to be using pot had a child in the car. As Providence car accident injury lawyers, this find is very troubling. The IIHS feels this reflects a variance between marijuana and alcohol use and it appears that marijuana use isn’t reserved for evenings and other occasions when adults are more likely to consume alcohol. Experts are uncertain whether this reflects an increase in the use of recreational pot or medical marijuana for pain treatment.  The IIHS is clear however, that there is a “correlation”, a connection, between the rise in crashes once pot became legal, however it is not the same as “causation”, meaning other variables could be involved. One of the difficulties with this study, as with similar reports, is the accuracy in measuring how marijuana use impacts car crashes because law enforcement has a difficult challenge due to the way marijuana works in the body.</p>


<p><strong>How Does Marijuana Impact a Driver?</strong></p>


<p>Multitudes of studies conclude that marijuana causes impairment in every performance area that can be reasonably connected with safe driving. When a person smokes marijuana or ingests it in another form, chemicals enter the body through the bloodstream to the brain followed by the rest of the body. THC, the most powerful chemical in marijuana, is mainly responsible for the “high” the drug gives off. Functions necessary for driving are impaired including motor coordination, visual functions, tracking, and more complex tasks that require divided attention. Studies on the effects of marijuana on reaction time, however, have been contradictory. Marijuana impacts the cognitive process differently than alcohol does and both can be extremely harmful to someone operating a motor vehicle. In fact, <a href="https://www.ncbi.nlm.nih.gov/pmc/articles/PMC2722956/" rel="noopener noreferrer" target="_blank">using both substances together can multiply the effects of impairment</a> thereby increasing the risk of involvement in a fatal car accident. A driver on the Rhode Island roads who is under the influence of both alcohol and marijuana is an even greater threat to themselves and others than a driver under the influence of either substance alone.</p>


<p><strong>Marijuana Levels Difficult to Measure in Drivers</strong></p>


<p>The effects of marijuana on a driver can be difficult to measure because of the testing method for THC, the active ingredient in marijuana, and its validity. If a driver involved in a car crash is suspected of being under the influence of marijuana, how can the police tell? When a police officer suspects a driver is drunk, a simple test can be performed to measure the blood alcohol content (BAC) in the person’s blood. <a href="http://webserver.rilin.state.ri.us/Statutes/TITLE31/31-27/31-27-2.HTM" rel="noopener noreferrer" target="_blank">Rhode Island law</a> defines a BAC of .08 or higher as driving while intoxicated (DWI)). If a motorist involved in an accident is suspected of being “high”, there is a different test that measures THC levels. THC levels spike when a person smokes or consumes marijuana in an alternative form. However, unlike BAC levels which drop rapidly as the person sobers up, THC can stay in the body for weeks long after the initial impact of the “high” has gone. Therefore, it is difficult to measure by test alone if the person was impaired at the time of the crash or had used the drug days, or even weeks, ago. The effects of marijuana can be challenging to measure and vary more among individuals than do the effects of alcohol because of tolerance, smoking technique, and varying absorption levels of THC.</p>


<p><strong>Driving Under the Influence of Marijuana in Rhode Island</strong></p>


<p>In Rhode Island, it is against the law for a driver to operate a motor vehicle if they have a detectable level of an illicit drug in their body. Repercussions vary depending on the level of the substance found in the body, type of substance, and whether it is a first, or subsequent offense, but may include fines, community service, suspension of driver’s license, educational courses, and imprisonment. Rhode Island has extensive laws concerning driving under the influence of liquor or drugs.</p>

Seniors are some of the safest drivers- they are more likely to wear seat-belts, drive sober, and observe speed limits. Yet they are more likely to die in a car crash than other age groups. Behind teenage drivers, seniors have the highest crash death rate per mile driven. With the population living longer, <a href="https://northeast.aaa.com/" rel="noopener noreferrer" target="_blank">AAA</a> researchers have found that older drivers are now outliving the age when they can drive safely by 7-10 years. <p>Rhode Island recently joined the ranks of six other states to ban a particular style of highway guardrail, the Lindsay X-LITE, due to concerns over the barriers crash safety. The X-LITE guardrails are believed by some to cause potential death or personal injury in car accidents by piercing, or impaling, the vehicles that come into contact with the barrier during a car crash. Several fatal crashes in the U.S. have involved this style of guardrail and the <a href="http://wpri.com/2018/01/24/rhode-island-to-remove-guardrails-blamed-in-deadly-crashes/" rel="noopener noreferrer" target="_blank">Rhode Island Department of Transportation plans to remove all of them</a> “out of an abundance of caution”, per DOT spokesman Charles St. Martin.
</p>



<h3 class="wp-block-heading" id="h-rhode-island-fatality-due-to-x-lite-guardrail"><strong>Rhode Island Fatality Due to X-LITE Guardrail</strong></h3>



<p>
There is one known fatality in Rhode Island involving the X-LITE guardrail. The <a href="/personal-injury/car-accidents/" rel="noopener" target="_blank">auto accident</a> fatality took place in Glocester, RI in May 2016. According to the police report, a 29-year-old Massachusetts man driving a pickup truck struck a 10-foot section of the guardrail, rode over the top of the barrier into a utility pole and down an embankment into a tree. The victim was pronounced dead at the scene. However, Glocester Police Chief Joseph DelPrete attributes the cause of the accident and its severity to <a href="/personal-injury/car-accidents/types-of-car-accidents/speeding-accidents/" rel="noopener" target="_blank">excessive speed</a>, as opposed to a faulty barrier. Chief DelPrete states the truck was driving 90mph on a tight road. The RIDOT did not review this particular incident or determine whether the guardrail is a safety hazard.</p>



<p>There are 31 states in the country currently using the X-LITE barriers. Rhode Island will be the 7<sup>th</sup> to remove them. The only other New England state that has decided to remove the Lindsay X-Lite guardrails is Vermont. As of now, Massachusetts has no plans to remove their approximate 2,600 sections of X-Lite barriers, the most of any state in the country. They do not plan, however, to purchase any more in the future.
</p>



<h3 class="wp-block-heading" id="h-campaign-pushed-by-tennessee-father-who-lost-daughter"><strong>Campaign Pushed by Tennessee Father Who Lost Daughter</strong></h3>



<p>
The decision by Rhode Island to remove the barriers was set off by investigations in other states as well as a Tennessee man named Steve Eimers who lost his 17-year-old daughter in a car crash when the highway guardrail pierced her vehicle. Incidentally, <a href="https://www.yahoo.com/lifestyle/grieving-father-hopes-reach-trump-taking-super-bowl-ad-florida-192857135.html" rel="noopener noreferrer" target="_blank">Mr. Eimers placed a $1,000 advertisement in Florida</a> this past Superbowl Sunday in the hopes of catching the attention of President Donald Trump watching the football game at his Mar-a-Largo home. Investigations by the Tennessee Department of Transportation found that the X-LITE failed to “telescope properly and pieces of it separated horizontally slicing into a vehicle”, according to the Tennessee DOT Commissioner. The manufacturer, Nebraska based <a href="http://www.barriersystemsinc.com/xlite-end-terminal" rel="noopener noreferrer" target="_blank">Lindsay Transportation Solutions</a>, maintains that the product has “successfully passed crash and safety tests in accordance with federal standards and criteria…. and “no road safety equipment can prevent injury every time a driver fails to stay on the road…”.
</p>



<h3 class="wp-block-heading" id="h-when-will-the-guardrails-be-removed-in-ri"><strong>When Will the Guardrails Be Removed in RI?</strong></h3>



<p>
Although Rhode Island has not done any independent investigations, they still plan to remove the potentially harmful barriers due to safety concerns. The RIDOT will remove approximately 350 of the current guardrails currently on RI highways. At this time, there is no cost estimated to remove or replace the X-LITE products and there is no time frame as to when the removal will take place.

However, it’s worth taking the time to understand, even in simple terms, what options are available as many of them are expected to, or have already proven to, assist in preventing car crashes resulting in serious personal injury or death based on <a href="https://www.nhtsa.gov/" target="_blank" rel="noopener noreferrer">National Highway Safety Transportation Administration (NHTSA)</a> studies. In <a href="/news/driver-assistance-technologies-sorting-options-part/" target="_blank" rel="noreferrer noopener">Part 1</a> of our personal injury blog on <a href="/news/driver-assistance-technologies-sorting-options-part/" target="_blank" rel="noreferrer noopener">Driver Assistance Technologies- Sorting Through the Options</a>, we explained the features of Automatic Emergency Braking Systems (AEB), Pedestrian Automatic Emergency Braking (PAEB), and Backup Cameras, or rearview cameras. In May 2018, <a href="/news/preventing-backover-accidents-backup-cameras-mandatory-may-2018/" target="_blank" rel="noreferrer noopener">backup cameras will be mandatory</a> on all new vehicles. As of now, backup cameras are the only one of these technologies that will be required shortly, but as further crash and safety studies become available, the NHTSA may add further features to the list of required technologies to be mandatory in new vehicles. In Part 2 of this Tapalian Law personal injury blog, we will look at the features and benefits of Forward Collision Warning Systems, Lane Assist or Lane Keeping Support Systems, Blind Spot Detection, and Automatic Crash Notification Systems (ACN or Call 911). These selections are available as options on many of the newer vehicles today.</p>



<h3 class="wp-block-heading" id="h-forward-collision-warning-system-fcw"><strong>Forward Collision Warning System (FCW)</strong></h3>



<p>
<u>How They Work</u>: A forward collision warning system works by using sensors to detect a vehicles speed, speed of the vehicle in front of it, and the distance between the two vehicles with the goal of avoiding or mitigating a rear-end crash. If the rear vehicle is getting too close to the stationary or slower moving automobile ahead of it, the FCW system will warn the driver of an impending crash so the driver is alerted to apply the brakes or steer in another direction to avoid a potential accident. The type of warning may be an audio or visual alert.</p>



<p>Unlike the AEB systems, the forward collision warning system does not take control of the car and apply the brakes itself. It is up to the vehicle operator to heed the warning and take action to prevent a crash. NHTSA lists certain FCW systems under their Recommended Safety Technologies and urge those in the market for a new vehicle to seek out this safety technology.
</p>



<h3 class="wp-block-heading" id="h-lane-assist-lane-departure-lane-keeping-support-systems"><strong>Lane Assist- Lane Departure/Lane Keeping Support Systems</strong></h3>



<p>
<u>How They Work</u>: Lane departure warning (LDW) systems and lane keeping systems (LKS) are similar in that they both use cameras to prevent motorists from unintentionally drifting out of their traffic lane. Cameras monitor lane markings on the road and detect when the vehicle is veering out of the lane. The LDW system will provide an audio or visual alert to the driver to correct the direction of the vehicle. It does not correct the vehicle for the driver. The LKS, on the other hand, does in fact automatically correct the steering and/or braking of the vehicle to return it to its original lane in order to prevent a crash with another car, truck, or SUV.  Though not required on vehicles, this technology may help in preventing both rollover accidents and sideswipe accidents. The features can also be helpful in alerting drivers that may be distracted or sleepy, to re-focus their attention on the road.
</p>



<h3 class="wp-block-heading" id="h-blind-spot-detection"><strong>Blind Spot Detection</strong></h3>



<p>
<u>How They Work</u>: Blind spot detection (BSD) systems work by using a camera or sensor to detect vehicles in adjacent lanes and warn the driver of approaching vehicles that may be in the driver’s “blind spot”. This can be especially helpful to a driver attempting to change lanes. The warning may be audio or visual, or both, depending on the particular system. Some blind spot technologies provide a warning within a certain space range or just if the vehicles turn signal is on. This could be very useful in the prevention of sideswipe crashes.
</p>



<h3 class="wp-block-heading" id="h-automatic-crash-notification-systems-acn"><strong>Automatic Crash Notification Systems (ACN)</strong></h3>



<p>
<u>How They Work</u>: Automatic crash notification systems, also known as a 911 notification, are a safety feature designed to notify emergency personnel when a car crash has occurred and where the vehicle is located. It does so by using a sensor that detects when an airbag has deployed or when there has been a sudden abnormal deceleration in vehicle speed. The crash notification system communicates with emergency responders to provide location and other vehicle information in order to accelerate assistance to the crash site.</p>



<p>This type of crash notification system can be especially useful in rural areas where witnesses and bystanders are less likely to be near the scene of a crash, therefore delaying the notification of emergency help. The quicker medical assistance can reach an injured victim, the better their chance of survival or less serious injury, depending on the severity of the crash.

We often hear about these new automobile technologies, but the choices can be overwhelming and confusing, especially if you are not a technology buff. <h3 class="wp-block-heading" id="h-automatic-emergency-braking-systems-aeb"><strong>Automatic Emergency Braking Systems (AEB)</strong></h3>



<p>
<u>How They Work</u>: Automatic Emergency Braking Systems, also called AEB, use a combination of sensors to detect an impending forward crash with another vehicle in time to avoid, or reduce, the effects of the crash.  Once an impending crash is sensed, the first step in the system is to alert the driver, (possibly by sound, display on the dashboard, or both), to take corrective action. If the driver does not take action to avoid the crash, the AEB system may take over and automatically apply the brakes to prevent or diminish the impact of the crash.</p>



<p>One-third of all police reported crashes in 2012 involved a rear end collision with another vehicle. Vehicles equipped with an AEB system could potentially prevent and lessen the severity of these common rear-end crashes, and corresponding injury, that we see so often as RI personal injury attorneys. NHTSA research shows that a number of these currently available systems are prove to be capable of avoiding or diminishing the severity of rear-end crashes in particular situations.

<h3 class="wp-block-heading" id="h-pedestrian-automatic-braking-system-paeb"><strong>Pedestrian Automatic Braking System (PAEB)</strong></h3>



<p>
<u>How They Work</u>: Similar to AEB systems, the Pedestrian Automatic Braking System (PAEB), uses a combination of sensors and cameras to detect a pedestrian in danger of being hit by a forward moving vehicle. The system will first alert the driver to the pedestrian and if appropriate action isn’t taken by the vehicle operator, the PAEB system will automatically apply the brakes in hopes of avoiding hitting the pedestrian. The PAEB system is also known as frontal pedestrian impact mitigation braking.</p>



<p><a href="/personal-injury/pedestrian-injuries/" rel="noopener" target="_blank">Pedestrian accidents</a> often occur when a pedestrian is crossing the street in front of a vehicle. Pedestrian crashes are most frequent when a vehicle is heading straight and a pedestrian is crossing the road; turning right or left and a pedestrian is crossing the road; or heading straight and a pedestrian is walking alongside or against traffic. The NHTSA recognizes this technology as a potentially life-saving feature that may be added to the list of recommended technologies down the road.
</p>

<p>Rhode Island traffic fatalities are at their highest since 2008, with 83 traffic related fatalities seen in the state in 2017. This is a jump from 51 traffic deaths seen in 2016 and 2014 in Rhode Island. Ironically, 2015 saw the lowest number of traffic fatalities in RI, 45, since 1992 according to the <a href="https://www.nhtsa.gov/" rel="noopener noreferrer" target="_blank">National Highway Traffic Safety Administration</a> (NHTSA). With increased auto safety features and public awareness campaigns about safer driving practices, one would expect to continually see a decrease in injuries and deaths from car accidents each year. So, it is alarming to see an uptick of 63% in just one year. Though we can not predict if this will realize a decrease in traffic fatalities, it may bring extra awareness to the serious issue of distracted driving.</p>



<h3 class="wp-block-heading" id="h-auto-related-deaths-across-the-country"><strong>Auto Related Deaths Across the Country</strong></h3>

Nationally, 2017 saw an increase in traffic fatalities all over the country. The NHTSA released data in October 2017 showing that almost 37,500 people lost their lives to auto accidents in 2016, which was an increase of 5.6 percent from 2015. Speeding related deaths increased by 4% and deaths due to failure to wear a seat belt were up 4.6%. Pedestrian deaths saw their biggest jump since 1990, increasing 9%. Deaths caused by alcohol impairment also jumped in 2016. In response to this increase, Rhode Island State Police launched a moving campaign to address drunk driving prior to the beginning of 2017. The campaign, “#BeyondtheCrash”, showed RI state troopers discussing the trauma inflicted by driving under the influence. Many believe these new infotainment systems need to be simpler to use, therefore decreasing the amount of attention they require from vehicle operators while driving.

<p>On October 6<sup>th</sup>, the U.S. Department of Transportation’s <a href="https://www.nhtsa.gov/" rel="noopener noreferrer" target="_blank">National Highway Traffic Safety Administration (NHTSA)</a> released fatal crash data for 2016. NHTSA data reports a 5.6% rise in traffic fatalities from 2015. Collected from all 50 states and the District of Columbia, data shows that 37,461 lives were lost on U.S. roads and highways in 2016 and equates to 102 traffic related fatalities, per day. An enormous 94% of serious crashes are related to human error, or human choice. It comes as no surprise that the biggest culprit of auto accidents deaths is <a href="/personal-injury/car-accidents/types-of-car-accidents/drunk-driving-accidents/" rel="noopener" target="_blank">drunk driving</a>, as this has long been the trend. <a href="/personal-injury/car-accidents/types-of-car-accidents/speeding-accidents/" rel="noopener" target="_blank">Speeding-related crash</a> fatalities closely follow behind drunk driving deaths. The NHTSA continually creates programs with the goal of expanding awareness of the acute risk of driving while impaired by alcohol or drugs. Alcohol-related fatalities in 2016 continue to account for a third of all motor vehicle deaths, following the trends of 2015 and 2014. Astoundingly, these accidents accounted for 10,497 deaths in the U.S. in 2016. This is especially tragic as drunk driving crashes are completely preventable. Impaired <a href="/personal-injury/motorcycle-accidents/" rel="noopener" target="_blank">motorcycle drivers</a> with a blood alcohol content (BAC) of .08 or higher accounted for the type of vehicle most frequently involved in these types of accidents, followed closely by passenger cars and light trucks. The age groups most often responsible for these fatal alcohol-related accidents were ages 21-24 and ages 25-34.</p>



<p>Besides alcohol, other reckless behaviors including speeding and not wearing a seat belt both experienced an uptick. <a href="/news/warwick-drivers-tested-undercover-pedestrians/" target="_blank" rel="noreferrer noopener">Pedestrian</a> deaths increased by a whopping 9%, the highest number of fatalities, 5,987, since 1990. Bicyclist deaths also saw the largest number of fatalities since 1991. The NHTSA report does not state the exact reason for the jump in pedestrian deaths but we may question whether there is a correlation between the up rise in <a href="/news/warwick-drivers-tested-undercover-pedestrians/" target="_blank" rel="noreferrer noopener">distracted walking</a> and pedestrian traffic deaths. Motorcyclist deaths also experienced an upsurge of 5%, the largest number of motorcyclist fatalities since 2008. On a more positive note, <a href="/news/self-driving-cars-road-sooner-think/" target="_blank" rel="noreferrer noopener">distraction-related</a> deaths, and drowsy-driving fatalities both decreased. The NHTSA continues its work on helping to address the human choices that account for so many of these traffic accidents and related fatalities.
