<p>Having been quarantined the last few months due to Covid-19, it’s understandable Rhode Islanders are anxious to get outside and back on the roads again. Traffic has already started to pick up and with the warmer weather, motorcycles are again prevalent on the streets and highways of Rhode Island.  Unfortunately, motorcycle collisions also rise as the weather warms up and as Personal Injury Attorney David Tapalian has seen first-hand, when a motorcyclist comes into physical contact with another motor vehicle or roadway object, it often results in significant or fatal injuries.  Last week, a Rhode Island man died in a <a href="https://www.providencejournal.com/news/20200618/lincoln-man-dies-in-motorcycle--crash" rel="noopener noreferrer" target="_blank">motorcycle crash</a> on the Route 146 South off-ramp in Lincoln when his motorcycle struck a curbed island in the road. Only a week prior, a Cranston man was killed in a motorcycle collision in Johnston on Route 6, Hartford Ave, after colliding with a pickup truck. Already two tragic motorcycle fatalities in the Ocean State and summer has just begun.</p>


<p><strong>Motorcycle Crashes Surge in Summer Months</strong></p>


<p>Across the U.S., <a href="/news/ri-motorcycle-accident-deaths-on-the-rise/" rel="noopener noreferrer" target="_blank">statistics</a> show motorcycle fatalities typically spike between the months of June and September. Rhode Island alone reported 18 motorcycle accident fatalities in 2018, a sharp increase from prior years. Riding a motorcycle is inherently riskier than driving a motor vehicle, like a car, truck, or SUV. Not only are motorcycles less stable when there’s a need to brake quickly or swerve, they are less visible to other drivers. When a <a href="/personal-injury/motorcycle-accidents/" rel="noopener noreferrer" target="_blank">motorcycle</a> is involved in a crash, the rider is much more likely to be severely injured, or killed, due to the lack of protection that a typical car or truck would provide. <p>With the arrival of Spring, electric scooters abound in Providence. Electric scooters, also known as e-scooters, are still new to the downtown scene having only arrived to cities nationwide in 2018. Being in their relative infancy, e-scooters and their safety have not yet been studied extensively. Marked by a rise in serious injuries to e-scooter users, especially first-time users, this safety concern was the catalyst for a recent <a href="http://www.austintexas.gov/edims/pio/document.cfm?id=318777" rel="noopener noreferrer" target="_blank">study</a> conducted by the Centers for Disease Control and Prevention (CDC) and Texas’ Austin Public Health Department to find out why there is such a high prevalence of injuries among electric scooter operators.</p>


<p><strong>What Prompted the Investigation into E-Scooter Injuries?</strong></p>


<p>A considerable rise in emergency room visits for users and pedestrians prompted Austin, Texas city leaders to request an investigation by the CDC into scooter-related crashes and injuries. Seeking alternative modes of transportation in the big city, especially emission-free transportation, Austin residents took to the streets when the e-scooters arrived. Following this, emergency rooms in the area began to notice a large number of visits from electric scooter drivers with broken bones and head injuries. The ER visits included injuries both minor and major, such as a University of Texas student, a star baseball shortstop, that missed his season after he hit a pothole riding an electric scooter tearing his Achilles tendon and requiring surgery. In January 2019, Austin experienced its first <a href="https://www.cnn.com/2019/03/04/health/scooter-injury-cdc-investigation-partner/index.html" rel="noopener noreferrer" target="_blank">scooter related death</a> when a 21-year-old University of Texas student died a day after suffering critical injuries after his electric scooter collided with a car.</p>


<p><strong>High Rate of Injury Among First-Time Electric Scooter Users</strong></p>


<p>The CDC report found an especially high rate of injury among new e-scooter riders, specifically one in three injured riders were hurt on their first trip. Almost half of the hurt riders had head injuries, only one of them was wearing a helmet. Not only are scooter operators getting hurt, but pedestrians are getting injured by moving scooters or tripping over scooters left carelessly on the sidewalk. Though the study was confined to emergency room visits in Austin, it led researchers to conclude that more training is needed for e-scooter riders.</p>


<p><strong>Why Are E-Scooters Dangerous?</strong></p>


<p>The main reason e-scooter operators are getting injured so often is inexperience. Lack of experience in novice users, and not following safety rules set out by the scooter companies, creates a great safety risk to both users as well as pedestrians and other cars and trucks on the road. Just like a motor vehicle driver, driving aggressively, speeding, using a cell phone, and driving intoxicated all increase the risk of injury to an electric scooter user. He added that a city bicycling advisory council provides input into bike safety as new projects are developed throughout Providence. Bicycle crossings have been installed by the Rhode Island Department of Transportation (RIDOT) at various busy intersections and “Sharrows”, symbols painted on the road with the symbol of a cyclist with arrows, were installed to remind drivers to share the road with bicyclists. After the death of the young boy in Bristol, RIDOT vowed to review every spot where dedicated bike paths cross roads. The Rhode Island Department of Environmental Management (RIDEM) is responsible for maintenance issues along the bike path and Rhode Islanders are encouraged to contact them with maintenance concerns like shrubbery overgrowth.</p>


<p><strong>Bicyclist Road Fatalities in Rhode Island</strong></p>


<p>Over 800 people were killed in 2015 in the U.S. in crashes involving a bicycle and motor vehicle, according to the <a href="https://www.nhtsa.gov/" rel="noopener noreferrer" target="_blank">National Highway Traffic Safety Administration (NHTSA)</a>. Deaths among bicyclists under the age of 20 have declined tremendously since 1975, perhaps due to a bigger push for children to wear bicycle helmets and safer areas to ride. <p>Providence residents were in for a surprise this summer when in mid-July, dozens of electric scooters showed up on the streets of Providence unannounced. With the newfound popularity of electric scooters to navigate cities like San Francisco, it was just a matter of time before the vehicles hit the streets of Providence. <a href="https://www.bird.co/" rel="noopener noreferrer" target="_blank">Bird</a>, the California company responsible for bringing the scooters to Providence, say they want to offer affordable, environmentally friendly vehicle options to communities.  The easily accessible vehicles, available through an app for $1 plus .15/minute, were a novelty with many interested in trying them if not just for the curiosity factor. But, just as quickly as they appeared and local residents got used to seeing them around, the scooters disappeared just a few weeks later due to a lack of regulation by the city. Bird says they plan to return to Rhode Island as soon as they comply with new regulations set forth by the city.</p>


<p><strong>Inexperienced Drivers Often Cause Accidents Resulting in Personal Injury </strong></p>


<p>While many view rental scooters as a welcome and environmentally friendly addition to cities, others have some concerns. Cities where rentals are currently offered have seen a spike in emergency injuries to riders, as well as pedestrians. The main cause for the injuries is inexperienced scooter operators. Some cities have already banned the use of scooters, such as Cambridge, MA, while others are providing a trial period for the vehicles to see what effect their usage has on traffic and safety and what regulations need to be put into place.</p>

The email spoke of several near crashes witnessed at the sight. With this email, Bristol was put on notice of a potentially dangerous problem. The question remains however whether even though the Town was alerted to the potential problem, did it properly address the safety issue and if so, did it continually maintain surveillance of the area to ensure its safety continued. The Town said at that time they worked to address the issue at the location by sending the Department of Transportation (DOT) to perform landscaping to improve visibility. Some nearby residents feel further safety measures need to be taken such as installing flashing lights and reducing the speed limit to make the intersection safer.</p>



<p><strong>Who is Responsible for Maintaining RI Bike Paths?</strong></p>



<p>In Rhode Island, the Rhode Island Department of Transportation (<a href="http://www.dot.ri.gov/" rel="noopener noreferrer" target="_blank">RIDOT</a>) is responsible for roadways and right of ways, but the Department of Environmental Management, or the town, are responsible for maintaining the bike paths. The East Bay Bike Path, constructed in phases between 1987 and 1992, is the first multi-town bike path built in Rhode Island and travels 14.5 miles. The RIDOT website states maintenance concerns with the bike path should be addressed to the Rhode Island Department of Environmental Management’s Division of Parks and Recreation.</p>



<p><strong>Rhode Island Bike Paths Will be Studied</strong></p>



<p>The RIDOT says it will conduct a safety study on the 200 intersections where bike paths cross with vehicle traffic. The study is expected to take 6 months. In the meantime, the brush has been cut back at the Bristol site making signs and the path easier to see. Temporary stop signs have also been placed by concerned citizens, which the Town of Bristol has approved for the time being. There is an existing regulation seven-foot-high stop sign on the path for bicyclists, however a sign at that height may be difficult for a child to see. <p>Although Rhode Island State Police can’t point to a single determining factor for the increase in motorcycle accident deaths, they do say it’s not just a concern only in Rhode Island. According to the <a href="/news/100-deadliest-days-of-summer/" target="_blank" rel="noreferrer noopener">National Highway Transportation Safety Association (NHTSA)</a> the number of motorcycle accident fatalities have increased 60% over the last 20 years. Federal statistics show that motorcycle fatalities typically spike each year between June and September. In 2016, nearly half of all motorcycle deaths occurred in those four summer months. <a href="https://www.tapinjury.com/news/100-deadliest-days-of-summer/" target="_blank" rel="noreferrer noopener">Car accident fatalities also rise</a> during the summer months, especially <a href="/news/over-400-road-related-fatalities-expected-this-memorial-day-weekend/" target="_blank" rel="noreferrer noopener">during summer holidays</a>, as we explored in a recent Tapalian Law personal injury blog. Although motorcycle fatalities have increased this year, motor vehicle related accidents have decreased from this time frame last year. There have been 27 motor vehicle accident fatalities through June 29, 2018. During the same time period in 2017, there were 39 fatalities. As Providence personal injury attorneys, we hope this downward auto accident fatality trend continues its decrease for the remainder of the summer.</p>



<p><strong>Rhode Island Motorcycle Helmet Laws</strong> <a href="/news/helmet-laws-rhode-island-motorcyclists/">Rhode Island does not require motorcycle operators to wear a helmet</a>. Rhode Island does, however, require all passengers riding on a motorcycle to wear a helmet. If the key fob is on the person, in their hand, a pocket, or purse within the designated distance range, the key fob can transmit a radio signal therefore allowing the car door to be opened or the engine started. On the other hand, it also allows the driver to exit the vehicle with the key fob while the car is still running. Many newer model cars, especially electric or hybrid vehicles, are extremely quiet leaving us to sometimes question if the engine is even running. Because the vehicle is so quiet, it can be easy to forget to turn off the engine and leave the vehicle running. Older drivers can be especially prone to doing so. But this is where the danger of carbon monoxide lies. If said vehicle is parked inside an enclosed garage attached to a home, the carbon monoxide can build up and seep into the home silently poisoning those inside, often in their sleep. Carbon monoxide is a poisonous gas that one cannot see, taste, or smell. When breathed in, it can displace oxygen in the blood depriving the heart, brain, and other vital organs of necessary oxygen. This can result in death. Those with carbon monoxide exposure that is not fatal may end up with other sicknesses and injuries such as headache, dizziness, vomiting, nausea, or unconsciousness, as well as brain damage. Some automotive manufacturers are facing <a href="/personal-injury/wrongful-death/" target="_blank" rel="noreferrer noopener">wrongful death</a> lawsuits or <a href="/personal-injury/" target="_blank" rel="noreferrer noopener">personal injury</a> lawsuits as a result.</p>

The reason? Without having to turn a key, the victims left their vehicle and forgot to turn off their engines resulting in carbon monoxide poisoning. Many of the deaths resulted from the running vehicle being left in an enclosed garage attached to a home.</p>



<p><strong>What Changes Are Being Made to Make Keyless Ignitions Safer?</strong></p>



<p>Years back a proposal was made by the Society of Automotive Engineers, the world’s leading automotive standards group, to require safety features in vehicles with keyless ignition. Suggestions included a series of beeps to alert drivers the car was still running without the key fob nearby, or for the engine to shut off automatically after a period of time. The <a href="https://www.nhtsa.gov/" rel="noopener noreferrer" target="_blank">National Highway Traffic Safety Administration (NHTSA)</a> supported similar implementations but nothing was ever finalized although proposals are still under review. Currently regulators are relying on individual car manufacturers to include these safety mechanisms voluntarily. While some vehicle manufacturers are going above and beyond these measures, others are falling short. For example, Toyota vehicles including Lexus, were involved in almost half of the carbon monoxides deaths and fatalities, per the report in the New York Times article. As of now, <a href="/personal-injury/wrongful-death/" rel="noopener" target="_blank">wrongful death</a> and personal injury lawsuits against various auto manufacturers for these deaths and injuries continue to increase.</p>

<p>A recent New York Times article titled, <a href="https://www.nytimes.com/2017/10/23/well/buckle-up-a-helmet-to-save-a-life.html" rel="noopener noreferrer" target="_blank"><em>Buckle Up a Helmet to Save a Life</em></a>, began “Riding a bicycle without a properly fitted helmet is simply stupid”. After seeing the aftermath and devastation one of our clients incurred after getting hit while riding his bicycle in Providence, as injury lawyers at Tapalian Law we tend to see the author’s point. A human on a bicycle is no match for a vehicle or SUV weighing between an average of 4,000-6,000 pounds. Our client was hit by an elderly woman and sustained serious injuries requiring hospitalization for over 30 days as well as a number of surgeries. Teenagers may balk at parental safety rules and fear looking “uncool” but parents must stand their ground. The latest data from the <a href="https://www.nhtsa.gov/" rel="noopener noreferrer" target="_blank">National Highway Transportation Safety Association</a> (NHTSA) shows that motorcyclists are 27 times as likely as passenger car occupants to die in a traffic crash and 6 times more likely to be injured.
