<p>Drivers in Rhode Island, Massachusetts, and across the U.S. are being urged by automakers to check their vehicles for airbag recalls as another death was confirmed this month related to a Takata airbag inflator. The vehicle involved in the fatality, a 2006 Ford Ranger pickup truck, was part of a <a href="https://www.nhtsa.gov/equipment/takata-recall-spotlight" rel="noopener noreferrer" target="_blank">major recall</a> and issued an urgent “do not drive” warning in 2018. It had yet to undergo repairs. Additional fatalities believed to be caused by malfunctioning airbags recently prompted Stellantis (formerly Fiat Chrysler) to issue an urgent “do not drive” order for certain 2005-2010 motor vehicles. Makes and models include the Dodge Charger, Magnum, and Challenger, and the Chrysler 300. The company is urging drivers of these cars who have not yet undergone a vehicle inspection in accordance with previous recall campaigns to <em>not operate </em>the vehicle until they have it inspected and repaired as deemed necessary. <p>Motorists are urged to check their vehicle immediately to determine if it is part of an airbag recall, or any other type of recall. <p><strong>The Future of Headlights</strong></p>


<p>In 2020, Ford issued a recall of their F-150 model due to a problem with headlight brightness. The switch that controlled the lights was unable to turn off the high beams when the low beams were in use. As a result, passing drivers were momentarily blinded as they attempted to pass or when they were directly in front of these vehicles. There are future developments that may affect how bright headlights appear moving forward and can hopefully prevent <a href="/personal-injury/" rel="noopener" target="_blank">injury</a> to those on the road at night. With the creation of adaptive driving beams, the hope is that there will be less glare for passing vehicles which will decrease the chance of car accidents. The new system automatically changes the setting based on how fast the car is going, how much light is around, and how far away other vehicles are, among other variables.</p>

<p>In what may be the largest child wrongful death settlement in U.S. history, Swedish furniture chain Ikea reached a $46 million settlement with a California couple whose 2-year-old son was killed in a tragic accident. The fatal accident occurred when an Ikea dresser tipped over and crushed the toddler in 2017. The young boy, Jozef Dudek, had been put down for a nap when the incident occurred. <p><strong>Injuries Leading Cause of Death for Children</strong></p>



<p>Accidental injuries are the leading cause of death for children under the age of 19, according to the Centers for Disease Control (CDC), and furniture tipping is more common, and dangerous, than one thinks. Every 30 minutes, a child is sent to the emergency room because of tipping furniture, according to the Consumer Product Safety Commission (CPSC), and a child dies every ten days. Sadly, most of these tip-over incidents are preventable.</p>



<p>According to legal documents filed by attorney’s in the wrongful death claim, the boy’s parents were safety-minded. They had baby-proofed their home and even secured other heavy pieces of furniture in the home considered to be a potential danger. Lawyers argued the couple never thought that the short, three-drawer dresser, the Malm model, was a concern and claimed that Ikea knew that the piece of furniture “lacked counterbalancing weight on the back and bottom of the dresser, causing the dresser to be top-heavy and front-heavy, so as to render it unstable”.</p>



<p>Child safety advocates say at least ten deaths are linked to Ikea dressers due to tip-over accidents, 9 of which involved a recalled dresser. <p>In a milestone case expected to be the first of many, a jury unanimously awarded a 46-year-old man $289 million in a lawsuit filed against Monsanto Company. <a href="https://monsanto.com/" rel="noopener noreferrer" target="_blank">Monsanto</a> is the maker of farming products and perhaps best known for developing Roundup, a popular weed killer used for decades on crops, lawns, golf courses, and gardens all over the world. The plaintiff, 46-year-old Dewayne Johnson, was diagnosed in 2014 with non-Hodgkin’s lymphoma, a type of cancer that kills approximately 20,000 people in the U.S. each year. The <a href="https://finance.yahoo.com/news/jury-awards-289m-man-blames-055859090.html" rel="noopener noreferrer" target="_blank">jury ruled</a> that Johnson’s years as a school groundskeeper using Roundup and Ranger Pro, a similar herbicide, on a daily basis contributed to his cancer. <p><strong>Potential Cancer-Causing Chemical in Roundup</strong></p>


<p>The potentially cancer-causing chemical at the forefront of the lawsuit is glyphosate. <a href="http://npic.orst.edu/factsheets/glyphogen.html#cancer" rel="noopener noreferrer" target="_blank">Glyphosate</a> is an active ingredient in both Roundup and Ranger Pro. Numerous studies claim a link between glyphosate and several cancers, the most thoroughly researched being non-Hodgkin’s lymphoma. In 2015, the <a href="http://www.who.int/ionizing_radiation/research/iarc/en/" rel="noopener noreferrer" target="_blank">World Health Organization’s International Agency for Research on Cancer (IARC)</a>, released a report that categorized glyphosate as a probable human carcinogen. Some countries are attempting to ban glyphosate products while the state of California has added a label to glyphosate products warning they contain a chemical known to cause cancer.</p>


<p><strong>Jurors Decision in Roundup Lawsuit</strong></p>


<p>The jurors in Johnson’s Roundup lawsuit were not asked to determine whether or not glyphosate causes cancer. Rather, the question asked of them was whether the chemical produces any harm and if Monsanto had knowledge of this but failed to warn consumers. Questions included:
</p>


<ul class="wp-block-list">
<li>Was Ranger Pro a substantial factor in causing harm to Mr. Johnson?</li>
<li>Did Ranger Pro have potential risks that were known or knowable in light of the scientific knowledge that was generally accepted in the scientific community at the time of its manufacture, distribution, or sale?</li>
<li>Did Monsanto fail to warn of the potential risks?</li>
<li>Was the lack of sufficient warnings a substantial factor in causing harm to Mr. Johnson?</li>
</ul>

<p>
Johnson’s lawyers claimed that not only was their client exposed to glyphosate on a regular basis but that on two occasions he was accidentally soaked in the chemical, despite wearing protective gear. After one of these incidents, Johnson developed a rash and contacted Monsanto but was never told the chemical could cause cancer. There is a paper trail at Monsanto showing a record of the conversation with Johnson and the lack of a subsequent follow up phone call on the part of Monsanto. <p><strong>Monsanto Plans to Appeal the $289 Million Award</strong></p>


<p>Monsanto plans to appeal the decision and continues to maintain that Roundup is safe and has been for over 40-years. The company cites “more than 800 scientific studies and reviews” showing no link to cancer. Monsanto attorneys also deny their product is responsible for Johnson’s cancer and argue that non-Hodgkin’s lymphoma “takes years to develop” and therefore Johnson must have developed the disease prior to working with the chemical on a daily basis as a groundskeeper.</p>

<p>The landmark lawsuit will likely open up a wealth of other cancer lawsuits against Monsanto (now owned by Bayer Group, who finalized an acquisition of Monsanto in June). <p>Polaris Industries, a manufacturer and distributor of recreational off-road vehicles, has agreed to pay a $27.25 million civil penalty for failing to immediately report to the <a href="https://www.cpsc.gov/" rel="noopener noreferrer" target="_blank">United States Consumer Product Safety Commission (CPSC)</a> defects in its off-road vehicles, also known as off-highway vehicles (OHVs). CPSC determined that the defects could cause an unreasonable risk of serious personal injury or death to recreational vehicle drivers and passengers. According to the CPSC, which is tasked with protecting the public from unreasonable risks of injury or death associated with consumer product use, injuries, death, and property damage from consumer product incidents cost the United States over $1 trillion each year. <h3 class="wp-block-heading" id="h-reason-for-the-27-25-million-civil-penalty"><strong>Reason for the $27.25 Million Civil Penalty</strong></h3>

A civil penalty is defined as a financial penalty imposed by a government agency as restitution for wrongdoing. The civil penalty the CPSC sought against Polaris resolved the violations concerning the RZR and Ranger ROV. CPSC agreed not to seek civil penalties for failure to report hazards or defects in vehicles that Polaris had reported to CPSC by June 29, 2017. Polaris also agreed to sustain an amped up compliance program to ensure future compliance with the Consumer Product Safety Act as well as internal controls to ensure any future incidents are dealt with in a timely manner. By Polaris settling this matter, it does not mean they admit to all of the CPSC charges.</p>



<p>The off-road vehicles involved in the Polaris $27.25 million civil penalty are the RZR and Ranger recreational off-road vehicles (ROVs). CPSC claims that Polaris received information the RZR could catch fire while driving, resulting in potential burns and injuries to drivers and passengers. Despite having this information that could cause a substantial hazard or unreasonable risk of serious injury or death, Polaris failed to report it to the CPSC as required by federal law. When Polaris finally did report the risk, it had already received reports of 150 fires, including one fatal fire, 11 burn injury reports, and a fire that consumed 10 acres of land. The Ranger ROV had problems concerning a heat shield that could come lose and fall off, posing fire and burn hazards. Polaris made two design changes to the vehicle, reported the fires to the CPSC, and also announced a recall of certain versions. However, even after the recall, Polaris continued to receive reports of problematic heat shields including fire reports. Polaris only reported these incidents to the CPSC when it had received 10 reports of heat shield concerns, including five involving fires.
</p>



<h3 class="wp-block-heading" id="h-off-highway-vehicle-ohv-safety"><strong>Off-Highway Vehicle (OHV) Safety</strong></h3>



<p>Although the terms are often used interchangeably, there are three main subsets of vehicles classified under the broad term of OHV. They are All-Terrain Vehicles (ATVs), Recreational Off-Highway Vehicles (ROVs), and Utility Task Vehicles (UTVs). Although there are <a href="/news/atv-related-injuries-children-severe-automobile-accidents/" target="_blank" rel="noreferrer noopener">differences between each</a> there is one very important thing to remember that is consistent with them all. Each carry risk of serious injury and death when not used properly or with the appropriate safety equipment. <p>Rhode Island recently joined the ranks of six other states to ban a particular style of highway guardrail, the Lindsay X-LITE, due to concerns over the barriers crash safety. The X-LITE guardrails are believed by some to cause potential death or personal injury in car accidents by piercing, or impaling, the vehicles that come into contact with the barrier during a car crash. Several fatal crashes in the U.S. have involved this style of guardrail and the <a href="http://wpri.com/2018/01/24/rhode-island-to-remove-guardrails-blamed-in-deadly-crashes/" rel="noopener noreferrer" target="_blank">Rhode Island Department of Transportation plans to remove all of them</a> “out of an abundance of caution”, per DOT spokesman Charles St. Martin.
</p>



<h3 class="wp-block-heading" id="h-rhode-island-fatality-due-to-x-lite-guardrail"><strong>Rhode Island Fatality Due to X-LITE Guardrail</strong></h3>



<p>
There is one known fatality in Rhode Island involving the X-LITE guardrail. The <a href="/personal-injury/car-accidents/" rel="noopener" target="_blank">auto accident</a> fatality took place in Glocester, RI in May 2016. According to the police report, a 29-year-old Massachusetts man driving a pickup truck struck a 10-foot section of the guardrail, rode over the top of the barrier into a utility pole and down an embankment into a tree. The victim was pronounced dead at the scene. However, Glocester Police Chief Joseph DelPrete attributes the cause of the accident and its severity to <a href="/personal-injury/car-accidents/types-of-car-accidents/speeding-accidents/" rel="noopener" target="_blank">excessive speed</a>, as opposed to a faulty barrier. Chief DelPrete states the truck was driving 90mph on a tight road. The RIDOT did not review this particular incident or determine whether the guardrail is a safety hazard.</p>



<p>There are 31 states in the country currently using the X-LITE barriers. Rhode Island will be the 7<sup>th</sup> to remove them. The only other New England state that has decided to remove the Lindsay X-Lite guardrails is Vermont. As of now, Massachusetts has no plans to remove their approximate 2,600 sections of X-Lite barriers, the most of any state in the country. They do not plan, however, to purchase any more in the future.
</p>



<h3 class="wp-block-heading" id="h-campaign-pushed-by-tennessee-father-who-lost-daughter"><strong>Campaign Pushed by Tennessee Father Who Lost Daughter</strong></h3>



<p>
The decision by Rhode Island to remove the barriers was set off by investigations in other states as well as a Tennessee man named Steve Eimers who lost his 17-year-old daughter in a car crash when the highway guardrail pierced her vehicle. Incidentally, <a href="https://www.yahoo.com/lifestyle/grieving-father-hopes-reach-trump-taking-super-bowl-ad-florida-192857135.html" rel="noopener noreferrer" target="_blank">Mr. Eimers placed a $1,000 advertisement in Florida</a> this past Superbowl Sunday in the hopes of catching the attention of President Donald Trump watching the football game at his Mar-a-Largo home. Investigations by the Tennessee Department of Transportation found that the X-LITE failed to “telescope properly and pieces of it separated horizontally slicing into a vehicle”, according to the Tennessee DOT Commissioner. The manufacturer, Nebraska based <a href="http://www.barriersystemsinc.com/xlite-end-terminal" rel="noopener noreferrer" target="_blank">Lindsay Transportation Solutions</a>, maintains that the product has “successfully passed crash and safety tests in accordance with federal standards and criteria…. and “no road safety equipment can prevent injury every time a driver fails to stay on the road…”.
</p>



<h3 class="wp-block-heading" id="h-when-will-the-guardrails-be-removed-in-ri"><strong>When Will the Guardrails Be Removed in RI?</strong></h3>



<p>
Although Rhode Island has not done any independent investigations, they still plan to remove the potentially harmful barriers due to safety concerns. The RIDOT will remove approximately 350 of the current guardrails currently on RI highways. At this time, there is no cost estimated to remove or replace the X-LITE products and there is no time frame as to when the removal will take place.
</p>

A December report from Surgeon General Vivek Murthy found e-cigarettes are now “the most commonly used form of tobacco among youth in the United States. In fact, use of e-cigarettes among high school students increased by 900% from 2011 to 2015, according to the report.</p>



<h2 class="wp-block-heading" id="h-how-do-e-cigarettes-work"><strong>How Do E-cigarettes Work?</strong></h2>



<p>E-cigarettes, or ENDS products, use a liquid that contains nicotine as well as varying combinations of flavoring, propylene glycol, glycerin, and other ingredients. This liquid is heated into an aerosol which is inhaled by the user. The liquid is heated into an aerosol that the user inhales and then exhales in a cloud. Flavorings might include mango, bubble gum, cherry, or other “sweet” flavors. Regular cigarettes, on the other hand, are banned from having added flavors to make them less enticing to children.</p>



<h2 class="wp-block-heading" id="h-latest-trend-in-e-cigarettes"><strong>Latest “Trend” in E-Cigarettes</strong></h2>

<p>According to CNN, new research finds that teens are using e-cigarettes for an alternative use, known as “dripping”. according to this article, “Dripping produces thicker clouds of vapor, gives a stronger sensation in the throat and makes flavors taste better”. In comparison to “vaping”, “dripping is a more labor-intensive method of vaping in which the user manually applies a few drops of liquid directly to the exposed heating coil of the e-cig every so many puffs,” said Alan Shihadeh, a professor of mechanical engineering and director of the Aerosol Research Laboratory at the American University of Beirut. Of those surveyed, one in four teens who vape say they’ve used e-cigarettes for “dripping,”.</p>



<h2 class="wp-block-heading" id="h-e-cigarette-tricks"><strong>E-Cigarette “Tricks”</strong></h2>

Another concerning alternative use of e-cigarettes? Smoke tricks. According to Suchitra Krishnan-Sarin, lead author and a professor in the department of psychiatry at the Yale University School of Medicine, “You can inhale the vapor or the aerosol, and then you blow it out of your mouth or nose, and you create all different kinds of shapes,” she said. “People create dragons and volcanoes and little hearts.” There are vape fests and competitions dedicated to smoke tricks, which are becoming popular.

<h2 class="wp-block-heading" id="h-safety-amp-health-concerns-about-e-cigarettes-amp-dripping"><strong>Safety & Health Concerns About E-Cigarettes & Dripping</strong></h2>



<p>According to the U.S. Food & Drug Administration (FDA), tobacco use is the single largest preventable cause of disease and death in the United States. Perhaps the e-cigarettes contain less nicotine than regular cigarettes but they still don’t come without health concerns. The risks and dangers of using e-cigarettes to a humans health are still not fully known. Complications are of even greater concern with “dripping” since a higher heat is used in dripping, therefore emitting a higher level of harmful chemicals. Some concerns with “dripping” are:</p>



<ul class="wp-block-list">
<li>Inhaling harmful chemicals including formaldehyde and acrolein, which may cause cancer.</li>



<li>Chemicals like propylene glycol and glycerine, and flavor chemicals, which when heated at high temperatures could produce high levels of carcinogenic compounds.</li>



<li>Absorption of nicotine through skin contact (skin absorbs nicotine rapidly) by handling the liquid.</li>



<li>If enough liquid is spilled a “vapor” could be exposed to toxic levels of nicotine.</li>



<li>Young children hurt by spilled liquid. An analysis of calls to the National Poison Data System estimated that more than seven young children accidentally ingest e-liquids left within reach in households each day.</li>

<h2 class="wp-block-heading" id="h-new-fda-regulations-for-e-cigarettes"><strong>New FDA Regulations for E-Cigarettes</strong></h2>



<p>
Since 2009, the FDA has regulated cigarettes, smokeless, and roll-your-own tobacco. Effective August 18, 2016, the FDA finalized a rule to regulate <em>all</em> tobacco products, including e-cigarettes. Retailers are prohibited from selling any of these products to those under the age of 18.</p>



<p>Beginning In 2018, ENDS product packing and advertisements must contain the warning statement “WARNING: This product contains nicotine. Nicotine is an addictive chemical.”. If the product does not contain nicotine but is still a tobacco related product, it must state “This product is made from tobacco.”</p>



<p>These new regulations are positive moves in keeping teens away from tobacco. However, some teens and adults may seemingly drop regular cigarettes for what they think is a “safer” tobacco alternative. Many of these products still contain nicotine, which is addictive. It is still early in the life of these products and only time will tell of the real health risk associated with e-cigarettes and similar products.
</p>

The Tokyo-based Honda adds these vehicles to the list of earlier recalls. About <a href="http://hondaairbaginfo.com/our-perspective-unprecedented-recall-unprecedented-efforts-11222016/" rel="noopener noreferrer" target="_blank">10.7 million Honda and Acura vehicles</a> in the U.S. are subject to a recall related to Takata airbag inflator ruptures. Some vehicles involve both a driver and passenger side airbag inflator, others involve just the passenger side.

<h2 class="wp-block-heading" id="h-reason-for-massive-recall"><strong>Reason for Massive Recall</strong></h2>



<p>
The <a href="http://hondaairbaginfo.com/" rel="noopener noreferrer" target="_blank">recall</a> is due to potentially faulty air bag deflators that could explode in a crash. The rupture could injure people by dispelling metal shrapnel into the passenger compartments. The air bag inflators are made by Takata Corp., a Japanese supplier.</p>



<p>Honda, and the National Highway Safety Administration (NHTSA), has focused specific concern on a subset of these inflators called “Alpha” inflators found in some 2001-2003 Honda and Acura vehicles. The “Alpha” inflators have a huge rupture rate- up to 50%. Due to their age and exposure to heat and humidity over time, these older model inflators are particularly vulnerable to explosion. Exploding shrapnel can cause serious personal injury, or even death, to the vehicle passengers and driver.

The metal shrapnel involved in the airbag rupture could cause serious personal injury, even death. Honda has confirmed ten deaths in the United States from 2009-2016 due to this complication. The vehicles involved have all since been put on recall. The deaths occurred in California (3), Texas (2), Pennsylvania, Louisiana, Florida, Oklahoma, and Virginia. 150 injuries have been reported in the United States related to the ruptures of the Takata supplied drivers front airbag inflators.

Honda urges owners to take their car to an authorized Honda dealership immediately. The repair is expected to take about an hour. If owners are not comfortable driving the car to the dealership, Honda will tow the vehicle at their own expense and provide a loaner. Honda states they have a large supply of replacement parts in-stock to complete the repairs quickly and with minimal inconvenience to owners. Since these vehicles are older they may have changed multiple hands since first purchase. Current owners may not have a relationship with a Honda dealership and therefore may not be aware of this recall. Honda has a wide outreach program underway and is publicly posting the recall information online, spreading the word through social media and friends and family of Honda and Acura employees and owners are urged to spread the word to those who may not be aware.</p>



<p>As of December 2016, Honda reports 51.2% of vehicles in the airbag recall have been repaired since the recalls began a few years back. Approximately, 8 million Takata inflators have been replaced in total. Honda considers this steady progress.</p>

The Samsung device exploded while the boy was watching videos. He suffered burns and he is now afraid of all phones, according to family members. The boy’s grandmother said that the device simply burst into flames. The Note 7’s battery exploded and set off smoke alarms in the home. The family called 911 and the boy was taken to a medical center where he was treated.</p>



<p>Other dangerous situations involving the Samsung Galaxy 7 Note have been reported throughout the United States. Samsung responded by taking the device off store shelves and <a href="https://www.cnet.com/news/samsung-confirms-global-recall-replacement-galaxy-note-7-faulty-battery/" rel="noopener noreferrer" target="_blank">issuing a recall</a>. Airlines have ordered anyone who is flying with one of the devices to shut off the phone during the flight. The device was even linked to a house fire in South Carolina.</p>

<p>These types of problems with products are often caused by the manufacturing rushing the item to market before it has been thoroughly tested.
