<p>On the same day, yet in separate incidents, two fatalities occurred in auto accidents in Falmouth, MA.  An early evening crash on Route 28 near the Route 151 off-ramp killed a Falmouth man on Sunday, February 20th. Traveling southbound, the man’s car veered off the road into the woods, hitting several trees in its path.</p>



<p>Earlier that morning, fire and rescue divers recovered the body of a 21-year-old man from Grafton, MA, whose vehicle was found submerged in water. This fatal crash occurred at the intersection of Central Avenue and Menauhant Road, two roads that lead to the ocean. Where these roads end, drivers must make a stop and turn either left or right. Located about 100 feet ahead is the ocean. Possibly missing this stop sign, and speed, are potential factors being investigated in this recent tragedy. By using human subjects in controlled environments, some under the influence of alcohol and others sober, they are able to work on differentiating between the BAC of a driver versus a passenger.</p>


<p>This differentiation is one concern held by those who question the effectiveness of impaired driving technology. Some are concerned about “false positives”, like the Executive Director of the ACLU, and the accuracy of the test to determine the difference between, for example, a sober driver and a drunk passenger, or vice versa.</p>


<p>To address apprehension about the cost, the President and CEO of KEA states the technology will be mass produced and therefore will scale down the cost. To others who fear for the privacy of their data, he feels this will be included in the auto manufacturer’s general policy which encompasses the privacy of other forms of in-vehicle data.</p>

<p>Governor Charlie Baker continues his push to crack down on drugged driving laws in Massachusetts. Baker’s legislation attempts to close many of the loopholes that allow motorists, such as the driver that killed State Trooper Thomas Cardy, to go free of penalty for driving under the influence of certain drugs and causing injury or death. Baker’s proposal, originally filed in 2019, has been refiled and named after Cardy, who was killed in 2016 during a traffic stop by a medical marijuana patient who was convicted of involuntary manslaughter, but acquitted of driving under the influence of cannabis. While breathalyzers provide reliable blood alcohol content (BAC) levels, accurately measuring the level of other substances, like marijuana, in a driver’s body proves to be more difficult, and controversial.</p>


<p><strong>Drugged Driving Bill in MA</strong></p>


<p>The aim of Governor Baker’s drugged driving bill is to close gaps in the current laws that can allow motorists impaired by drugs such as cannabis, prescription medications, and other drugs, to be held unaccountable for these offenses. The <a href="https://www.bostonherald.com/2021/12/14/police-driving-groups-back-baker-bill-to-crack-down-on-drugged-driving/" rel="noopener noreferrer" target="_blank">proposal</a> seeks to expand the 12-step drug recognition expert (DRE) training for police officers to identify whether a person is impaired and if so, by what substances. The DRE process includes specialized observations of the motorist as well as measurements of heart rate, temperature, and blood pressure. The bill would also subject suspected drivers to a blood test for THC (the primary active ingredient in marijuana) and require Massachusetts courts to recognize the DRE trained police officers as experts.
<strong>Does Legal Marijuana Use Result in More Auto Accidents?</strong></p>


<p>While marijuana usage was made legal in Massachusetts in 2016, whether or not its legalization has contributed to an increase in auto accidents is a hot topic.  <a href="https://www.iihs.org/news/detail/crash-rates-jump-in-wake-of-marijuana-legalization-new-studies-show" rel="noopener noreferrer" target="_blank">Studies</a> by the Insurance Institute for Highway Safety (IIHS) found that auto accidents increased in states that eased up on their recreational marijuana laws compared to those states where marijuana remained illegal. (The particular studies cited did not involve Massachusetts.) Accidents involving injuries rose by 6% while those that ended up in death also rose by 4%. The amount of accident claims filed following the legalization of marijuana has increased in the range of 3% to 21% depending on the state in question. When it comes to whether the actual ingestion of marijuana is causing this increase, the results are more mixed. Studies found that those under the influence of marijuana have slower reaction times and are more likely to drive into other lanes unintentionally, while other studies found that marijuana users often drive slower and remain farther away from other vehicles.</p>


<p>The difficulty in conclusively analyzing the effects of marijuana on drivers is that there are significantly less reliable drug tests performed on the road compared to alcohol exams. When a driver is using both substances, it can be difficult to pinpoint which one is causing the symptoms in question. In addition, the reliability of blood tests for THC has been taken into question by those opposed by the bill.</p>


<p><strong>Marijuana Use & Car Accidents</strong></p>


<p>Still debatable, one potential theory for why legal recreational marijuana use has increased accident rates in some states is that people are more likely to drink <a href="/personal-injury/car-accidents/types-of-car-accidents/drunk-driving-accidents/" rel="noopener" target="_blank">alcohol</a> at the same time as using drugs such as marijuana, but future studies are needed to test this theory. An analysis based on self-reporting found that joint use of marijuana and alcohol has increased according to the AAA Foundation, which also found those who engaged in both of these activities at the same time were more likely to get behind the wheel of a car and drive recklessly than a driver consuming alcohol only. The analysis also stated that drivers using both substances at once were also 20% more likely to speed and 16% more likely to drive through red lights as opposed to drivers only under the influence of alcohol. They also were 24% more likely to act <a href="/personal-injury/car-accidents/types-of-car-accidents/aggressive-driving-accident-attorney-in-ri/" rel="noopener" target="_blank">aggressively</a> on the roadways and 19% more likely to <a href="/personal-injury/car-accidents/types-of-car-accidents/texting-driving/" rel="noopener" target="_blank">text</a> at the same time as operating their vehicles.</p>

<p>Each year in the U.S., about 10,000 people die in drunk driving accidents, according to the NHTSA. In an effort to put a dent in this startling number of completely preventable deaths, Congress is making a push with an anti-drunk driving provision for new cars in its infrastructure bill. The <a href="https://www.autoblog.com/2021/11/10/drunk-driving-car-technology-infrastructure-bill/" rel="noopener noreferrer" target="_blank">proposed legislation</a>, if passed, will require automakers to include technology that detects and stops drunk drivers in motor vehicles by as early as 2026. <p><strong>How Can Vehicle Technology Prevent Drunk Driving Accidents? </strong></p>


<p>With an infinite number of safety options available in today’s newest vehicles, from sensors and cameras that detect pedestrians to approaching cars in a motorist’s blind spot, it seems logical that some type of anti-drunk driving technology would be an addition to the large menu of options. Yet, the critical question remains of exactly <em>how</em> to prevent <a href="/personal-injury/car-accidents/types-of-car-accidents/drunk-driving-accidents/" rel="noopener" target="_blank">drunk driving crashes</a> with the latest in technology. The proposed bill isn’t exact, but calls for something that will “passively monitor the performance of a driver of a motor vehicle to accurately identify whether that driver may be impaired”. Studies will need to be conducted involving various alcohol detection systems before recommendations are provided to auto manufacturers.  Infrared cameras are one example, and are currently being utilized by car manufacturers like GM and Nissan. The camera looks for signs of a lack of driver alertness, such as drowsiness or impairment, and if identified, warns the driver and if need be, takes further action. Another idea tested by Volvo involves alcohol sensors that detect a driver’s blood alcohol content (BAC) by measuring the air inside the vehicle. Ultimately, the Department of Transportation will have to make the final call as to what is the best solution to put a damper on intoxicated drivers.</p>


<p><strong>Car Safety Measures in Infrastructure Bill </strong></p>


<p>The issue of drunk driving is clearly a critical one and has been for decades, with approximately 30% of traffic deaths involving an intoxicated motorist. A <a href="https://www.iihs.org/news/detail/alcohol-detection-systems-could-prevent-more-than-a-fourth-of-u-s-road-fatalities" rel="noopener noreferrer" target="_blank">2020 report</a> by the Insurance Institute for Highway Safety (IIHS) predicted built-in anti-drunk driving technology in vehicles could prevent over a quarter of the traffic fatalities in the U.S. each year.</p>


<p>Other motor vehicle safety provisions proposed in the infrastructure bill include emergency braking systems and technology that can alert parents and caregivers to children left in the backseat, to avoid the potential tragedy of a child being left in a hot car.  It’s unclear how, or when, these mandates will take place, but they are seen by many as a positive move in the right direction towards preventing drunk driving crashes as well as injuries and needless fatalities from other types of <a href="/personal-injury/car-accidents/" rel="noopener" target="_blank">auto accidents</a>.</p>

<p>From January to early May, 23 people have been killed so far this year in Rhode Island car accidents. For the past four years, the number of deaths in Rhode Island auto accidents has increased and there are a few different theories for the increase in traffic deaths throughout the state. One thought involves the COVID-19 pandemic which saw a <a href="/news/ri-traffic-accident-deaths-up-despite-less-driving/" rel="noopener" target="_blank">great reduction</a> in the number of drivers on the road.  However, having less vehicles to contend with, the motorists that were using the roads felt like they could driver faster, and more recklessly, than usual. <p>The Rhode Island Department of Transportation has made a big effort to inform people of the damages that can result from careless driving; over 8 million dollars has been spent on ads that show the most devastating results of a crash, such as family members crying, bodies in a morgue, and crushed cars. The department also placed alarm systems on ramps that go off and activate bright lights to alert a driver that they are driving in the <a href="/personal-injury/car-accidents/types-of-car-accidents/wrong-way-car-accidents/" rel="noopener" target="_blank">wrong direction</a>. <p>Normally a relaxed summer getaway for visitors, Rhode Island’s Block Island has <a href="https://www.providencejournal.com/news/20200821/block-island-looks-for-answers-amid-spike-in-moped-crashes-injuries-and-deaths" rel="noopener noreferrer" target="_blank">suffered</a> a number of tragic traffic fatalities as well as a number of serious injuries over the last month. In early August, a male teenager from Connecticut suffered fatal injuries in a car accident when the female driver, suspected of being intoxicated, lost control of her vehicle on West Side Road. Later that same week, a 22-year old Cranston man riding a moped was killed in a head-on collision with an SUV.  Most recently, a passenger was injured in a roll-over crash and the 20-year old driver under suspicion for driving under the influence. <p>The U.S. Department of Transportation’s National Highway Transportation Safety Administration (NHTSA) released <a href="https://crashstats.nhtsa.dot.gov/Api/Public/ViewPublication/812874" rel="noopener noreferrer" target="_blank">preliminary data</a> in late December that shows a decline in motor vehicle accident deaths for the first nine months of 2019. From January to September 2019, an estimated 26,730 fatalities occurred in U.S. auto accidents, compared to 27,335 fatalities during the same January to September period of 2018. A 2.2% deduction in motor vehicle fatalities is reflected, despite vehicle miles traveled during this period having increased by 1%. <p><strong>How are the Statistics Compiled?</strong></p>


<p>The NHTSA compiles motor vehicle traffic fatality statistics using police crash reports, among other sources. One source, NHTSA’s Fatality Analysis Reporting System (FARS), is a census of fatal traffic crashes in the U.S. (the 50 states, District of Columbia, and Puerto Rico). For a crash to be involved in FARS, it must involve a motor vehicle accident traveling on a traffic way and the resulting death of at least one person (vehicle occupant or nonoccupant) within 30 days of the crash.</p>


<p><strong>Contributing Factors to Fatal Accidents</strong></p>

<p>Attorney David Tapalian, a Coventry car accident lawyer, recently obtained a $50,000 full policy limit settlement award for a young woman injured in a horrific auto accident in Coventry. The teenager was struck at a high speed by a drunk driver and was very fortunate to survive the crash. <p><strong>Drunk Driver Cause of Coventry Car Accident </strong></p>


<p>The significant <a href="/personal-injury/car-accidents/types-of-car-accidents/head-on-collisions/" rel="noopener noreferrer" target="_blank">head-on collision</a> occurred on Main Street in Coventry, Rhode Island, when the defendant crossed over the yellow line into the opposite lane of travel. The crash was clearly caused by the highly intoxicated defendant.  The responding Coventry police officer provided a very thorough description in his police narrative and took his time to be extremely detailed in describing the defendant’s impairments. This individual was charged with driving under the influence of alcohol at the scene of the accident.</p>

While at the hospital, injuries were noted to her back, shoulders, face, wrist burns and numbness in both arms.  In addition, she experienced temporary loss of hearing with concussion related symptoms such as forgetfulness, nausea, and significant headaches. <p>Since the legalization of marijuana movement began in the U.S., health and safety experts have been trying to measure the potential impact it would have on traffic accidents. Without ample past reliable data to go off, much of the results so far have been inconsistent. However, according to a new set of studies by the Insurance Institute for Highway Safety’s (IIHS) Highway Loss Data Institute, <a href="https://www.iihs.org/iihs/news/desktopnews/crashes-rise-in-first-states-to-begin-legalized-retail-sales-of-recreational-marijuana" rel="noopener noreferrer" target="_blank">an increase of up to 6 percent in the number of highway crashes</a> has been found in four states where the recreational use of marijuana is legalized. As Providence personal injury lawyers, Tapalian Law feels any uptick in car crashes is reason to sit up and take notice. While the latest reports cannot yet prove a direct risk caused by the use of marijuana among vehicle operators, there is a rising trend in these states and any upsurge in <a href="/personal-injury/car-accidents/" rel="noopener" target="_blank">car crashes</a> is cause for attention. At this time it is a challenge to accurately test drivers to determine if they are under the influence of THC, the active ingredient in marijuana. Without this hard proof, much more research needs to be done to explore marijuana use and its relationship to vehicle crashes. After this Tuesday’s election, <a href="https://www.businessinsider.com/legal-marijuana-states-2018-1" rel="noopener noreferrer" target="_blank">10 states and Washington D.C. have now legalized marijuana for recreational use</a> for adults over the age of 21. Rhode Island has not legalized marijuana for recreational use. Medical marijuana is legalized in 33 states, including Rhode Island.</p>


<p><strong>Results of IIHS Study Linking Legalized Marijuana to Car Crashes</strong></p>


<p>The <a href="https://www.iihs.org/iihs/news/desktopnews/crashes-rise-in-first-states-to-begin-legalized-retail-sales-of-recreational-marijuana" rel="noopener noreferrer" target="_blank">IIHS studies</a> used police reports and insurance claims to determine auto crashes rose between 5.2% and 6% in states with legalized recreational marijuana, in comparison to neighboring states where marijuana use is illegal. Highway crash data from surrounding states was also compared in an attempt to control for factors like weather and economy. One disturbing find from the study is that while most <a href="/personal-injury/car-accidents/types-of-car-accidents/drunk-driving-accidents/" rel="noopener" target="_blank">drivers under the influence of alcohol</a> are driving alone or with other adults, approximately 14% of those confirmed to be using pot had a child in the car. As Providence car accident injury lawyers, this find is very troubling. The IIHS feels this reflects a variance between marijuana and alcohol use and it appears that marijuana use isn’t reserved for evenings and other occasions when adults are more likely to consume alcohol. Experts are uncertain whether this reflects an increase in the use of recreational pot or medical marijuana for pain treatment.  The IIHS is clear however, that there is a “correlation”, a connection, between the rise in crashes once pot became legal, however it is not the same as “causation”, meaning other variables could be involved. One of the difficulties with this study, as with similar reports, is the accuracy in measuring how marijuana use impacts car crashes because law enforcement has a difficult challenge due to the way marijuana works in the body.</p>


<p><strong>How Does Marijuana Impact a Driver?</strong></p>


<p>Multitudes of studies conclude that marijuana causes impairment in every performance area that can be reasonably connected with safe driving. When a person smokes marijuana or ingests it in another form, chemicals enter the body through the bloodstream to the brain followed by the rest of the body. THC, the most powerful chemical in marijuana, is mainly responsible for the “high” the drug gives off. Functions necessary for driving are impaired including motor coordination, visual functions, tracking, and more complex tasks that require divided attention. Studies on the effects of marijuana on reaction time, however, have been contradictory. <p>There’s more bad news for the chronically sleep deprived. Not only are they perpetually tired but also more at risk for causing a car accident. According to a <a href="https://aaafoundation.org/" rel="noopener noreferrer" target="_blank">AAA</a> study, drivers functioning on less than 4 hours of sleep have crash risks similar to those of an intoxicated driver with a blood alcohol content (BAC) of .12. (<a href="http://webserver.rilin.state.ri.us/Statutes/TITLE31/31-27/31-27-2.HTM" rel="noopener noreferrer" target="_blank">Rhode Island law</a> defines a BAC of .08 or higher as driving while intoxicated (DWI)). So, an exhausted truck driver who skimped on sleep in order to reach their destination on-time may be just as much of a danger as a drunk driver on the road! The <a href="/" rel="noopener" target="_blank">Providence, RI car accident injury lawyers</a> at Tapalian Law know it can be difficult to pinpoint the cause of an auto accident and this is especially true for car crashes caused by a sleep-deprived driver. We do know that truck drivers are particularly vulnerable to driving while tired due to long, and often monotonous, hours on the road. <p><strong>AAA Sleep Deprivation Study: Poor Sleep Alters Brain Function</strong></p>


<p>The AAA Foundation for Traffic Safety conducted a review of data from 6,800 car accidents for the period of 2005-2007 to study the effects of sleep deprivation on driving. Only the data from drivers determined to be culpable (whose errors, actions, or lack of actions, led to the crash), were used.  Accidents involving external factors, like brake failure or poor infrastructure, were not factored into the report. The goal of the review was to “quantify” the correlation between hours of sleep and crash risk. The study found that <strong>less than 7 hours of sleep increases a driver’s risk of a crash</strong>. By far, the <strong>greatest risk of crash occurs when a driver is operating on less than 4 hours of sleep</strong>. Poor sleep affects brain function and impairs judgement. Fatigued drivers are not just “nodding off at the wheel”, but their decision-making process is also highly impacted by poor sleep quantity and quality. Vehicle operators with less than 4 hours of sleep are more likely to be involved in a single car crash. Fatalities are 3 times more likely with a single vehicle crash than a multi-vehicle crash.</p>


<p><strong>Statistics on Drowsy Driving</strong></p>


<p>The following statistics are based on car accident data related to sleep impairment provided by the <a href="https://www.nhtsa.gov/" rel="noopener noreferrer" target="_blank">National Highway Traffic Safety Administration (NHTSA)</a>.

<p>Most everyone has seen the mug shot of Tiger Woods after <a href="http://www.cnn.com/2017/05/29/us/tiger-woods-arrested-dui/index.html" rel="noopener noreferrer" target="_blank">his recent arrest</a> for DUI in Jupiter, Florida. Upon hearing of his arrest for driving under the influence, or DUI, many automatically assumed he was under the influence of alcohol and driving drunk. After all, it was reported his speech was slurred, he failed basic roadside sobriety tests, and he was falling asleep at the wheel. All classic signs of alcohol impaired driving, and all too recognizable by the auto accident lawyers at Tapalian Law, as signs of a dangerous and impaired driver. While a crime often used to charge drunk drivers, DUI, or driving while impaired (DWI) includes not just driving under the influence of alcohol, but can also be impairment from other drugs, both recreational and prescription drugs, or a combination of any of these substances. The impairment by the substance, or combination of substances, brings the driver to a level rendering them incapable of operating a motor vehicle safely. In the case of Tiger Woods, it appears he was not using alcohol, but was influenced by several medications, reportedly including Vicodin (an opioid pain reliever), Torix (an anti-inflammatory), and another sleeping medication. Due to a recent back surgery Woods had undergone, these types of medications would not be uncommon after a major surgery.

<h3 class="wp-block-heading"><strong>DUI Involving Prescription Drugs a Growing Problem in America</strong></h3>

<p>
According to the <a href="https://www.nhtsa.gov/" rel="noopener noreferrer" target="_blank">National Highway Traffic Safety Administration</a>, the number of drivers involved in fatal auto crashes testing positive for drugs has doubled in the past 10 years. Illicit drugs are included in these figures but the lesser known drugs involved in these crashes are prescription medications, over the counter drugs, and supplements. Often times accidental overdoses occur as many patients do not comprehend the impact that mixing prescription drugs with other drugs, even as seemingly simple as allergy medication, or alcohol, can have on them. In fact, it is reported that nearly half of men and two-thirds of woman over the age of 65, are taking five or more medications at once. Sometimes a patient may forget that they took a medication already, and take it again, resulting in an overdose with impairing effects. It’s not always possible to predict the outcome that a combination of drugs, both prescription and non-prescription, will have on a person. The situation is even more difficult to predict when a patient is taking multiple drugs, prescribed by multiple doctors.

<h3 class="wp-block-heading"><strong>Effects of Prescription Drugs on Driving</strong></h3>

While it is true that opiate medications, such as Vicodin, have their purpose for certain patients after surgery, they should not be used by driving and need to be closely monitored. All opiate type medications come with a warning to not drive or operate heavy machinery. This is extremely important to heed as these drugs can impair reflexes and reaction times, and the effects are often worsened when mixed with other drugs or alcohol. The car crashed into a utility pole killing two of the young woman instantly, the third later died at Rhode Island Hospital. The driver and another front-seat passenger incurred minor injuries. When the vehicle hit the utility pole, the impact tore the back seat from the front seat. None of the young ladies in the back seat were wearing a seatbelt and all were ejected from the vehicle. The front seat passenger, who is an accident witness, was wearing a seatbelt and survived the wreck. The driver fled the scene of the accident and was found a quarter of a mile away. Pawtucket police said Belanger told the police he had a “couple of beers” and two marijuana cigarettes the evening of the accident. He was also in possession of cocaine. Belanger has been charged with three counts of duty to stop in an accident resulting in personal injury and/or death. As required by <a href="http://law.justia.com/codes/rhode-island/2016/title-31/chapter-31-26/section-31-26-1/" rel="noopener noreferrer" target="_blank">Rhode Island law</a>, when a driver is involved in any type of accident they must stop. Failing to stop after being involved in an accident involving personal injury or death can mean loss of license, fines, and/or imprisonment for the driver. He is also charged with three counts of driving to endanger with death resulting, and one count each of possession of cocaine and driving while in the possession of a controlled substance.
