<p>In December 2025, Brown University and the surrounding community were shaken by a devastating act of violence that left two Brown students dead and nine others injured during a mass shooting at the Barus and Holley Engineering Building on the Providence campus. Two days later, authorities tied the same suspect to the fatal shooting of a distinguished MIT professor at his home in Brookline, Massachusetts — an event that sent shockwaves through both academic communities.&nbsp;</p>



<p>The suspect — <em>Cláudio Manuel Neves Valente</em>, a former Brown physics graduate student — embarked on a shooting spree that began inside an undergraduate lecture hall and culminated in a separate killing in Brookline before he was found dead in a New Hampshire storage unit after a multi-day manhunt.</p>



<h2 class="wp-block-heading" id="h-what-happened-a-summary-of-the-facts">What Happened: A Summary of the Facts</h2>



<p>On December 13, 2025, the gunman entered the Barus and Holley building during a crowded exam-period review session, opened fire, and fled the scene before police arrived. Two students were killed instantly and nine others were wounded.&nbsp;</p>



<p>In the immediate aftermath, Brown University faced intense scrutiny over the lack of detailed surveillance video from inside the building, issues with building access protocols, and delays in issuing campus alerts.</p>

<p><em>Subsequent remedial measures</em> — improvements made after an incident (like adding more cameras or shoring up alert systems) — are generally inadmissible at trial to prove negligence or culpability under most civil rules (e.g., Federal Rule of Evidence 407). However, such measures can be admissible for other purposes (e.g., ownership, feasibility, or witness credibility); and Rhode Island Rules of Civil Procedure do allow them at times to be used as an inference of prior negligence. It will be interesting to see how Brown handles changes that it most certainly will make with adding surveillance and varying security protocols and how that could impact the impending litigation that’s almost certainly to arise due to this terrible and unfortunate circumstance.</p>



<h2 class="wp-block-heading" id="h-settlement-likelihood-early-expectations">Settlement Likelihood: Early Expectations</h2>



<p>Given the severity of the tragedy — multiple fatalities and high-profile victims — it would not be surprising if Brown University and prospective claimants pursue a prompt negotiated resolution rather than protracted litigation. There are several reasons:</p>

<p>At some point each day, most of us are a pedestrian, especially as we try to increase our time outdoors, and distance from others, amid the Covid-19 pandemic. Some stroll or jog for exercise, walk to school, to work, or to pick up lunch. Others are walking the dog or pushing a stroller. Being a pedestrian is a typical part of our day, especially in walkable cities like Providence, where sidewalks and pedestrian bridges are easily accessible to those on foot. Unfortunately, however, the rate of pedestrians killed in traffic crashes is at its highest in almost 20 years. According to the most recent data, 6,283 pedestrian fatalities were recorded in 2018. With daylight savings time on the horizon, daylight hours will decrease and pedestrians will be outside when its darker, increasing the risk for a potential <a href="/personal-injury/pedestrian-injuries/causes-of-pedestrian-accidents/" rel="noopener noreferrer" target="_blank">accident</a>. During the months of September to February, over 30% of pedestrian fatalities occur between the hours of 6:00pm and 8:59pm, according to the NHTSA.</p>



<p><strong>Safety is a Shared Responsibility</strong></p>



<p>The safety of a pedestrian isn’t the sole responsibility of the person doing the walking or jogging. Pedestrian safety is a shared responsibility and belongs to both the pedestrian and drivers on the road. It’s vital that both the driver and the pedestrian are constantly alert, minimize distractions, and follow proper safety protocol in order to minimize the chance of injury or death from a tragic incident. <li>Stay alert. Don’t use electronic devices, including earphones or earbuds, that take your eyes, ears, and attention off the road.</li>



<li>Cross at <a href="/personal-injury/pedestrian-injuries/crosswalk-accidents/" target="_blank" rel="noopener noreferrer">crosswalks</a> or <a href="/personal-injury/car-accidents/types-of-car-accidents/car-accidents-at-intersections-traffic-signals/" target="_blank" rel="noopener noreferrer">intersections</a> when available. If neither is available, cross at a well-lit area with a good view of traffic coming both ways and wait for a safe gap in traffic before crossing.</li>



<li>Wear bright colors during the day, and reflective materials at night. Use a flashlight at night for extra visibility. Make eye contact with drivers to ensure you are seen.</li>



<li>Be alert to cars entering, exiting, or backing up in driveways or parking lots.</li>
</ul>

<strong>Tips for Drivers</strong>
</p>



<ul class="wp-block-list">
<li>Be alert for pedestrians at all times when driving. Be extra cautious when visibility is lessened, such as night time and during poor weather conditions.</li>



<li>At crosswalks, slow down and be prepared to stop. Never pass a vehicle stopped at a crosswalk as people may be crossing that you cannot see.</li>



<li>Always yield to pedestrians in a crosswalk. Leave plenty of room for them and for other vehicles to see and stop for them.</li>



<li>Follow the speed limit, especially in areas where there are people around. Use extra caution and slow down in school zones and neighborhoods with children present.</li>



<li>When backing up, use extra caution and don’t rely solely on technology like backup cameras. Young children, especially, are vulnerable to <a href="/news/preventing-backover-accidents-backup-cameras-mandatory-may-2018/" target="_blank" rel="noopener noreferrer">backover accidents.</a></li>

According to information from the Substance Abuse And Mental Health Services Administration (SAMHSA), more than 11,000 young people between the ages of 12 and 17 years will try alcohol for the first time on any given day during December. If two or more vehicles are involved, how much fault is each responsible for? What happens if a truck hits a vehicle three cars behind you causing the cars directly behind you to crash into your car? Who is at fault? The car behind you? The truck who caused the accident? It’s not often easy to determine yet it is very important. Whomever is at fault will be responsible for paying damages. If multiple vehicles are involved, it will  also depend on which state you are in. Different states have different laws and you need an experienced car accident lawyer to help you sift through the details. Here are a few pointers to keep in mind if you’ve been involved in a multi car accident in RI or MA.</p>



<h2 class="wp-block-heading" id="h-multi-car-accidents-in-rhode-island">Multi-car accidents in Rhode Island</h2>

<li>“Comparative fault” rule: In Rhode Island, if more than one party is at fault, it is determined what percentage each is at fault for. If determined that Car 1 is responsible for 60% of the accident, and Car 2 is responsible for 40% of the accident- they are each responsible for that portion of the damages.  This rule applies in RI no matter how much, or little, each is responsible. Even if one party is 99 % and the other is 1%.</li>



<li>RI does not cap damages in personal injury or medical malpractice cases. (However, plaintiffs in wrongful death cases may not recover punitive damages in RI)</li>



<li><a href="http://webserver.rilin.state.ri.us/Statutes/Title9/9-1/9-1-14.HTM" target="_blank" rel="noopener noreferrer"><u>3 year statute of limitations to file a lawsuit</u></a>. If a lawsuit is not filed by then, most likely your case will be thrown out. Time is of the essence. The more time that goes by from the date of your accident, even mere days, the more difficult it is to recover damages from a car accident injury.</li>



<li>Injury claims involving the potential liability of a state level government employee or government agency have 3 years to file a claim (not lawsuit) after an injury. Claim must be filed with the RI Attorney General.</li>
</ul>



<h2 class="wp-block-heading" id="h-multi-car-accidents-in-massachusetts">Multi-car accidents in Massachusetts</h2>

<li>“Comparative fault” rule: In the Massachusetts version of this rule,  damages are reduced if an injured person shares less than 50% of the fault from an injury. It eliminates damages if the injured person is 50% or more at fault.</li>



<li>MA caps non-economic damages at $500k in medical practice cases only unless certain requirements are met.</li>

<li>Injury claims involving city, county or government agency are given 2 years to file a formal claim, 3 years to file a lawsuit.</li>

<p>According to a story reported by Wicked Local, a motorcyclist was killed, and three other people were transported to Rhode Island Hospital after a crash in Lakeville. The crash, which is still under investigation, involved two motorcycles and a 2007 Toyota Highlander SUV. The state police are reconstructing the Lakeville motorcycle accident in an attempt to determine what caused the tragic traffic accident.</p>



<p>The motorcycle accident occurred on Route 18 near Tamarack Park around 10 a.m. on October 21. The man who died was driving one of the motorcycles. His passenger and the other motorcyclist were transported to the hospital along with the driver of the SUV.</p>

<h2 class="wp-block-heading" id="h-rhode-island-clamps-down-on-wrong-way-car-accidents">Rhode Island Clamps Down on Wrong-Way Car Accidents</h2>



<p>Five people were killed last week, including four college students, in a <a href="https://www.tapinjury.com/news/5-killed-mass-car-accident/">wrong way crash in Massachusetts</a>. Although wrong-way car accidents only amount to 3% of car accidents, they are 12-27 percent more fatal than other types of vehicle accidents. Most of these crashes occur between 12-3am on weekends and often involve alcohol or confusion by the driver.</p>



<h2 class="wp-block-heading" id="h-rhode-island-taking-action"><strong>Rhode Island taking action</strong></h2>



<p>Recently, the Rhode island Department of Transportion (RIDOT) began to install <a href="http://www.wbur.org/hereandnow/2016/10/27/wrong-way-accidents" rel="noopener noreferrer" target="_blank"><u>wrong way crash avoidance</u></a> systems in hopes of reducing, or ideally eliminating, these types of car accidents. The system essentially helps notify drivers of their mistake.  Modeled after a similar project in San Antonio, Texas, the RIDOT worked with the RI State Police to get a feel for how these wrong-way car accidents happen and what they evolve into. Based on traffic accident reports, RIDOT targeted 25 locations which had a high occurrence of wrong-way crashes. So far 25 of the systems have been installed in RI, with another 25 planned for the next year or so.</p>



<h3 class="wp-block-heading" id="h-how-it-works">How it works.</h3>



<p>According to <a href="http://dot.ri.gov/about/" rel="noopener noreferrer" target="_blank"><u>Peter Alviti</u></a>, director of the RIDOT, the system works in three phases.  First, a radar activated early warning system detects a vehicle moving in the wrong direction. A flashing sign is activated to notify the wrong-way driver. Then a camera takes a picture of the vehicle. A second radar detector will determine if the driver corrected their mistake. If not, an alert is sent to the RIDOT as well as state and local police. The alert includes a picture of the vehicle. The RIDOT posts a flashing sign on that same highway to caution other drivers of a wrong-way vehicle.</p>



<h3 class="wp-block-heading" id="h-can-you-put-a-price-on-preventing-a-fatality">Can you put a price on preventing a fatality?</h3>



<p>The new detection system is part of a $2 million project that included other safety improvements on the highway. The 25 locations break down to about $25,000 each, or $160,000 of the $2 million project. With that in mind, during the last 18 months in all the 25 sites where the systems have been installed there have been zero crashes, zero injuries, and zero fatalities. In the previous five years at the same 25 sites, there were 16 crashes, 23 injuries, and eight fatalities.</p>



<p>Alviti says 66 wrong-way driving incidents happened at these 25 sites without an accident since the new systems were installed. There is no way of knowing which of those incidents would’ve ended in a crash involving injuries or a fatality. But the safety statistics speak for themselves. </strong></h3>



<p>Some of the things you do after a car accident can impair your ability to recover full compensation for your injuries, damages, and losses. Avoid the following missteps to protect your right to a fair and full settlement for your accident claim.</p>



<h2 class="wp-block-heading" id="h-1-failing-to-stop">1. Failing to Stop</h2>



<p>Failing to stop at the scene of a car accident is against the law in Rhode Island, regardless of the severity of the collision. Always remain at the accident scene until the police arrive.</p>

You do not want to give the insurance company for the other driver any reason to claim that you are at fault or even partially at fault.</p>



<h2 class="wp-block-heading" id="h-4-confronting-the-other-driver">4. Confronting the Other Driver</h2>



<p>Do not lose your cool after a car accident. Keeping calm may be very difficult if the other driver is clearly at fault, your vehicle is severely damaged, or your child is injured. It is dangerous to allow your temper to explode in this situation. For one, you have no idea what the other driver could do if confronted. Try to remain calm and focus on securing the accident scene and assisting your passengers.</p>



<h2 class="wp-block-heading" id="h-5-failing-to-document-the-accident-scene">5. Failing to Document the Accident Scene</h2>



<p>If possible, take pictures of the vehicles and the accident scene. Do not risk your safety by standing too close to traffic or venturing into the road. Ask for the names and addresses of any eyewitnesses, in addition to obtaining information from the other driver (i.e. name, address, insurance information, etc.).</p>

Furthermore, delaying medical care could damage your accident claim. The insurance company may argue that your injuries are not as severe as you claim or your injuries are the result of another accident that occurred after the collision in question.</p>

<p>Memories fade over time. It is important that you make notes about the car accident as soon as possible while the details are fresh on your mind. Include what you remember before, during, and after the car accident. Write down details of conversations you had or you heard at the accident scene. As your case proceeds, keep notes about your recovery, including your pain level and how the injuries impact your daily life. Also, keep notes about each conversation you have regarding the collision and your injuries.</p>

<p>You are not under a legal obligation to provide a written or recorded statement to the insurance company for the other driver. Five people were killed early this morning in a head-on collision. A wrong way driver is the cause of this deadly accident.  Massachusetts State Police said the driver was heading south in the northbound lane just after midnight. The driver crashed into another vehicle carrying four people. All five people in both cars died.

Anthony Thomas, the commanding office of the State Police barracks in Middleboro, said State Police received a call about a wrong-way driver at 12:11am, shortly before the crash occurred. It is unknown how long the vehicle was on the highway before the accident happened. Police say the victim’s car burst into flames after being hit head-on by the wrong-way driver in the high- speed lane. It appears there was not enough time for the vehicle carrying the four passengers to react to the oncoming driver. Thomas said the four people in the car that was hit were all “young adults”. Names of those involved in the car accident have not yet been disclosed. The northbound lane was closed for several hours and re-opened around 5:30am.</p>

The Samsung device exploded while the boy was watching videos. He suffered burns and he is now afraid of all phones, according to family members. The boy’s grandmother said that the device simply burst into flames. The Note 7’s battery exploded and set off smoke alarms in the home. The family called 911 and the boy was taken to a medical center where he was treated.</p>



<p>Other dangerous situations involving the Samsung Galaxy 7 Note have been reported throughout the United States. Samsung responded by taking the device off store shelves and <a href="https://www.cnet.com/news/samsung-confirms-global-recall-replacement-galaxy-note-7-faulty-battery/" rel="noopener noreferrer" target="_blank">issuing a recall</a>. Airlines have ordered anyone who is flying with one of the devices to shut off the phone during the flight. The device was even linked to a house fire in South Carolina.</p>

This information should cause concern for anyone who may need medical care in the future. The startling study sheds light on the mistakes made by healthcare professionals that result in the wrongful deaths of many patients each year.</p>



<h3 class="wp-block-heading" id="h-what-did-the-research-show"><strong>What Did The  Research Show?<br>
</strong></h3>



<p>Researchers analyzed data for medical death rates over an eight-year period. After reviewing the data, patient safety experts concluded that over 250,000 deaths each year are the result of medical errors. The study, published in The BMJ, revealed that medical errors surpass respiratory disease as the third leading cause of death in the United States.</p>



<p>According to the study, there is not a classification for medical errors as a cause of death on a death certificate. Up to this point, medical errors haven’t been included as a reason for death in any method for the collection of national statistics.  This has resulted in medical errors being excluded from national health statistics.</p>



<p>The top causes of death in the United States, according to the Centers for Disease Control, are:</p>

<li>Heart disease</li>



<li>Cancer</li>



<li>Chronic respiratory disease</li>
</ol>



<p>After reviewing the data from four separate studies from 2000 through 2008, the researchers deduced that almost 251,500 deaths were the result of medical errors. This represented approximately 9.5 percent of all deaths each year, thereby placing medical errors as the third leading cause of death above chronic respiratory disease.</p>



<p>Because the top causes of death receive funding for research and become priorities for public health professionals, it is important to ensure that all leading causes of death are included in the list — including medical errors.</p>



<h3 class="wp-block-heading" id="h-why-medical-errors-happen"><strong>Why Medical Errors Happen</strong></h3>



<p>A medical error isn’t necessarily an indication of a bad doctor, but of a system that needs to be improved. Furthermore, some nursing home patients are not elderly. A story reported by <a href="https://www.bostonglobe.com/metro/2016/09/10/neglected-peril-substance-abuse-nursing-homes/XpTd53Hl1b7Sx6csij8GVJ/story.html" rel="noopener noreferrer" target="_blank">The Boston Globe</a> earlier this month is an example of how nursing home abuse can take many forms.</p>



<h3 class="wp-block-heading" id="h-substance-abuse-in-massachusetts-nursing-homes"><strong>Substance Abuse in Massachusetts Nursing Homes</strong></h3>



<p>A 43-year old man entered Braemoor Health Center last summer to learn how to walk again following the amputation of his lower leg due to massive infections. He was a recovering heroin addict. He died just three days after he was released from the nursing home from an opioid overdose. According to his family, during the seven months he was in the nursing home, he received increasing doses of opioid medications without receiving substance abuse counseling.</p>



<p>Braemoor is one of at least two nursing homes in Massachusetts that have been cited by state inspectors for serious violations. The violations include a lack of substance abuse treatment and staff training. According to specialists, the number of patients with substance abuse issues in nursing homes is expected to grow as baby boomers reach an age where they need nursing home care. A report by the Office of the Inspector General found that millions of elderly Americans on Medicare are prescribed medications containing commonly abused opioids.</p>



<p>The Massachusetts Health Department said it is “finalizing written treatment guidelines to assist nursing homes in caring for those suffering from substance misuse.” In addition, the Health Department has trained inspectors regarding the abuse of drugs in nursing homes. Unfortunately, this action by the state is too late for the man who died after being discharged from Braemoor. According to his family, they questioned the use of narcotics and asked for assistance when he was discharged. They were told to simply go to the emergency room.</p>

<p>On September 8, The Sun Chronicle reported three people were injured in a four-car accident on Route 123 (East Main Street) in Norton. All four vehicles involved in the traffic accident were traveling westbound on East Main Street at the time of the traffic accident. One driver was transported to Rhode Island Hospital in Providence and two other drivers were transported to Sturdy Memorial Hospital in Attleboro. All three drivers had non-life-threatening injuries. The fourth driver in the traffic accident was not injured.</p>



<p>According to the police, the driver of a Cadillac SUV collided with the vehicle in front of him causing a chain reaction traffic accident. The driver of the Cadillac SUV has been charged with negligent operation of a motor vehicle and marked lanes violation. The driver of another vehicle involved in the traffic accident was charged with operating a motor vehicle with a suspended driver’s license. Law enforcement officers continue to investigate the traffic accident.</p>

<p>A former driver for <a href="http://www.providencejournal.com/news/20160921/former-uber-lyft-driver-charged-with-assaulting-passengers" rel="noopener noreferrer" target="_blank">Uber and Lyft </a>was charged  with assault on several female passengers while on the job in California, according to Escondido police. Investigators say there are more victims. A college student reported she was assaulted last week after requesting an Uber car near San Diego. The woman told police the driver picked her up on a college campus and proceeded to turn off the Uber app. She texted her friends to tell them she was uncomfortable and he drove her to another location. There he attacked her in his vehicle. Later that day the driver, Jeremy Vague, was arrested by police at his home. During the investigation, detectives discovered other victims of the same driver.</p>



<p><strong>Safety Tips</strong></p>



<p>Both Uber and Lyft have safety guidelines in place for drivers and passengers, such as Uber’s background check service Checkr. But past behavior may not always accurately predict future behavior.
