<p>When a car accident occurs and a police officer is called to the scene of the accident, they usually must file an electronic report form with the Rhode Island DMV within two weeks. This report details what the officer saw at the scene of the accident, statements from the drivers involved, and (depending on the case) their personal assessment of which party(s) were at fault. If the accident resulted in any physical injuries or property damage valued above $1,000, officers are required to submit an accident report. You should always call the police after an accident in order for them to assess the scene, but there are times where the police may not respond in a timely manner. Under certain conditions, all the drivers involved must file their own accident reports with the DMV within a 21 day period. If any injuries or property damage valued at over $1,000 were sustained, drivers are required to self-report.&nbsp;</p>



<p>After the officer and/or parties involved file a report, the state government puts it into a database so that it may be accessed later if necessary. The information from a report may also be used when compiling car accident statistics or data for policy changes and decisions down the line.</p>

<p>Here are the elements that an accident report typically consists of:</p>

<li>The specific location and time of the accident, with the location stated to the nearest intersection. If the accident didn’t happen at an intersection, the officer needs to record the distance (in feet) and direction to the closest intersection.</li>

<p>On the same day, yet in separate incidents, two fatalities occurred in auto accidents in Falmouth, MA.  An early evening crash on Route 28 near the Route 151 off-ramp killed a Falmouth man on Sunday, February 20th. Traveling southbound, the man’s car veered off the road into the woods, hitting several trees in its path.</p>



<p>Earlier that morning, fire and rescue divers recovered the body of a 21-year-old man from Grafton, MA, whose vehicle was found submerged in water. This fatal crash occurred at the intersection of Central Avenue and Menauhant Road, two roads that lead to the ocean. Where these roads end, drivers must make a stop and turn either left or right. Located about 100 feet ahead is the ocean. Possibly missing this stop sign, and speed, are potential factors being investigated in this recent tragedy. <p>Each year in the U.S., about 10,000 people die in drunk driving accidents, according to the NHTSA. In an effort to put a dent in this startling number of completely preventable deaths, Congress is making a push with an anti-drunk driving provision for new cars in its infrastructure bill. The <a href="https://www.autoblog.com/2021/11/10/drunk-driving-car-technology-infrastructure-bill/" rel="noopener noreferrer" target="_blank">proposed legislation</a>, if passed, will require automakers to include technology that detects and stops drunk drivers in motor vehicles by as early as 2026. <p><strong>How Can Vehicle Technology Prevent Drunk Driving Accidents? </strong></p>


<p>With an infinite number of safety options available in today’s newest vehicles, from sensors and cameras that detect pedestrians to approaching cars in a motorist’s blind spot, it seems logical that some type of anti-drunk driving technology would be an addition to the large menu of options. Yet, the critical question remains of exactly <em>how</em> to prevent <a href="/personal-injury/car-accidents/types-of-car-accidents/drunk-driving-accidents/" rel="noopener" target="_blank">drunk driving crashes</a> with the latest in technology. The proposed bill isn’t exact, but calls for something that will “passively monitor the performance of a driver of a motor vehicle to accurately identify whether that driver may be impaired”. Studies will need to be conducted involving various alcohol detection systems before recommendations are provided to auto manufacturers.  Infrared cameras are one example, and are currently being utilized by car manufacturers like GM and Nissan. The camera looks for signs of a lack of driver alertness, such as drowsiness or impairment, and if identified, warns the driver and if need be, takes further action. Another idea tested by Volvo involves alcohol sensors that detect a driver’s blood alcohol content (BAC) by measuring the air inside the vehicle. Ultimately, the Department of Transportation will have to make the final call as to what is the best solution to put a damper on intoxicated drivers.</p>


<p><strong>Car Safety Measures in Infrastructure Bill </strong></p>


<p>The issue of drunk driving is clearly a critical one and has been for decades, with approximately 30% of traffic deaths involving an intoxicated motorist. A <a href="https://www.iihs.org/news/detail/alcohol-detection-systems-could-prevent-more-than-a-fourth-of-u-s-road-fatalities" rel="noopener noreferrer" target="_blank">2020 report</a> by the Insurance Institute for Highway Safety (IIHS) predicted built-in anti-drunk driving technology in vehicles could prevent over a quarter of the traffic fatalities in the U.S. each year.</p>


<p>Other motor vehicle safety provisions proposed in the infrastructure bill include emergency braking systems and technology that can alert parents and caregivers to children left in the backseat, to avoid the potential tragedy of a child being left in a hot car.  It’s unclear how, or when, these mandates will take place, but they are seen by many as a positive move in the right direction towards preventing drunk driving crashes as well as injuries and needless fatalities from other types of <a href="/personal-injury/car-accidents/" rel="noopener" target="_blank">auto accidents</a>.</p>

<p><strong>How Much Value Does a Car Lose After an Accident?</strong></p>


<p>Currently, if your vehicle is damaged in an <a href="/communities-served/massachusetts/massachusetts-car-accident-lawyer/" rel="noopener" target="_blank">auto accident</a> in Massachusetts by another driver who is at-fault, the at-fault driver’s insurance company is responsible for paying for your vehicle repairs. That’s well and good to get you back on the road, but what happens when you decide to sell that car in the future? When it comes to resale, you’re likely going to get less money for that same car because it’s been involved in a crash.</p>


<p>So, just how much value does your car lose after it’s been involved in a crash? That depends on a number of factors including, of course, year, make, model, and mileage, but also whether the vehicle has been involved in a serious collision or a minor wreck. According to a recent <a href="https://www.bostonglobe.com/2021/10/27/business/answering-questions-about-your-cars-value-after-crash/" rel="noopener noreferrer" target="_blank">report</a>, online auto sites show the loss in value is typically between 10-25%. On average, this amounts to a loss of about $2,000 in value for a car involved in a serious wreck, and approximately $500 for all vehicles involved in crashes.</p>


<p>This loss in value is called <em>intangible value</em>– what happens after the vehicle is fully repaired but regardless, its resale value still plummets. The insurance companies refer to this intangible loss as <em>“inherent diminished value”</em>, or IDV. If you’ve been in a car accident, whether your car is new or old, and even if it’s been meticulously repaired after the collision, you’ve probably experienced some surprise at the price hit it has taken when you decide to sell it on the private market or back to a dealer.</p>


<p><strong>How Might IDV Change for Massachusetts Drivers?</strong></p>


<p>Until now, the insurance companies have been responsible for paying for vehicle repairs, but not IDV. Therefore, the owner of the vehicle is on the line for absorbing whatever loss in value takes place upon resale. However, a Supreme Judicial Court ruling in Massachusetts on October 19, 2021 is changing who is monetarily affected by that loss in value. With this new ruling, the court says that the at-fault insurance company is now responsible for the loss in value, or IDV.</p>


<p>If you do qualify, getting compensated for the IDV is not automatic at this time. Claimants wishing to seek compensation are responsible for proving and quantifying their loss to the court, likely with the support of an accident attorney who will probably involve outside experts, such as licensed appraisers. Currently, there is no method specified to quantify the amount of damage and therefore, it’s expected insurance companies will fight this ruling as such. It also remains to be seen whether the ruling will be retroactive for past cases.</p>
