<p>Tesla is well-known for their innovations in the electric vehicle industry, notably their Autopilot system technology. Autopilot is not designed to be used solely without human input; however, many users treat it that way which has resulted in a rash of deadly accidents, and legal action, against the enormously lucrative company. Tesla claims their systems are designed to reduce automobile crashes caused by human error and distractions, which account for a majority of the roughly 40,000 traffic fatalities in the U.S. each year. However, the NHTSA has a dozen active investigations into crashes involving this assistive driving technology, and recently released a list of at least 10 fatalities from <a href="https://www.nytimes.com/2021/07/05/business/tesla-autopilot-lawsuits-safety.html?referringSource=articleShare" rel="noopener noreferrer" target="_blank">crashes involving Autopilot</a> since 2016.</p>

<p><strong>Recent Tesla Accidents </strong></p>


<p>The NHTSA is investigating a number of instances involving the Tesla autopilot system malfunctioning and resulting in <a href="/personal-injury/" rel="noopener" target="_blank">personal injury</a> or death. A crash in 2019 took the life of a 15-year-old boy whose father was driving a pickup truck and turned on his blinker to switch lanes. While changing lanes, the Tesla vehicle traveling behind him at a high speed did not slow down. As a result, the truck was <a href="/personal-injury/car-accidents/types-of-car-accidents/rear-end-collisions/" rel="noopener" target="_blank">rear-ended</a> in the collision and the child was ejected and killed. Further investigation into the incident found that the Tesla was using the Autopilot system at the time of the crash. The technology, and the Tesla operator, failed to slow down the vehicle with an adequate amount of time to prevent the crash. Other Tesla crashes were due to the Autopilot system not braking for other vehicles and, in one instance, the technology did not notice a nearby concrete barrier. The drivers in both cases were killed.</p>


<p>The founder of Tesla, Elon Musk, says that his company is taking the proper precautions to avoid <a href="/personal-injury/car-accidents/wrongful-death-car-accident-attorney/" rel="noopener" target="_blank">fatal accidents</a>. Tesla often mentions how many of the accidents caused by their vehicles were the fault of the driver. The National Transportation Board has another view. They say that Tesla is not taking adequate safety measures to ensure drivers are using the technology correctly. Even when the intensity of brightness is similar for both of them, our eyes perceive the latter as brighter. Halogens also have a decreased brightness measure of 1300 lumens compared to LEDs which are 1600 lumens. In addition, there are even brighter lights called high-intensity discharge/xenon, that measure 3000 lumens and the potential for laser headlights emitting 6400 lumens.</p>


<p>Headlights not only have different intensity levels, but they possess different measured temperatures. As lights increase in temperature, they begin to glow and get whiter which is perceived by the human eye as brighter. Beyond the physical lights themselves, different conditions can affect the way our eyes perceive them. For example, excessive sun and overuse can cause headlights to develop a haze that increases the chance of glare.</p>


<p><strong>The Future of Headlights</strong></p>


<p>In 2020, Ford issued a recall of their F-150 model due to a problem with headlight brightness. The switch that controlled the lights was unable to turn off the high beams when the low beams were in use. As a result, passing drivers were momentarily blinded as they attempted to pass or when they were directly in front of these vehicles. There are future developments that may affect how bright headlights appear moving forward and can hopefully prevent <a href="/personal-injury/" rel="noopener" target="_blank">injury</a> to those on the road at night. With the creation of adaptive driving beams, the hope is that there will be less glare for passing vehicles which will decrease the chance of car accidents. <p>The great majority of us use a cell phone on a daily basis and most of us walk someplace too, whether to pick up a child at the bus stop, a lunch break to pick up a sandwich, or walking the dog. But lately it’s become riskier as a <a href="https://www.cnn.com/2020/02/03/health/texting-pedestrian-safety-study-wellness-scli-intl/index.html" rel="noopener noreferrer" target="_blank">recent study</a> shows that using your phone as you walk is more dangerous, and likely to cause an accident, than listening to music or even talking on the phone. <p>It’s official. Massachusetts marks the final New England state to join the ban on hands-free driving by making hand-held cell phone use illegal while operating a motor vehicle. Effective February 23, 2020, it will be illegal to use a hand-held cell phone while driving in Massachusetts. Texting while driving was already illegal in the Bay State, having been banned in 2010. Yet, distracted driving car crashes in MA rose an alarming 170 percent from 2014-2016. Across the U.S., over 3,000 people were killed in <a href="/personal-injury/car-accidents/types-of-car-accidents/distracted-driving-accidents/" target="_blank" rel="noopener noreferrer">distracted driving</a> accidents in 2017 alone. There’s no question whether using a cell phone while driving is safe.</p>



<p><strong>Massachusetts Hands-Free Law</strong></p>



<p>As of February 23<sup>rd</sup>, under <em>An Act requiring the hands-free use of mobile telephones while driving</em>, use of electronic devices by motor vehicle operators and bicyclists, including cell phones and tablets, will be prohibited unless being used in hands-free mode. <u>“Hands-free mode”</u>, defined by Mass General Law, is the “operation of a mobile electronic device by which a user engages in a voice communication or receives audio without touching or holding the device; provided, however, that a mobile electronic device may require a single tap or swipe to activate, deactivate or initiate the hands-free mode feature”.</p>



<ul class="wp-block-list">
<li><em>All</em> electronic device use is prohibited for drivers <em>under the age of 18</em>, even in hands-free mode. <strong>Primary Enforcement of a Traffic Offense</strong></p>



<p>As with the hands-free law in Rhode Island enacted in 2018, violation of the hands-free law in Massachusetts is considered a primary traffic offense. Primary enforcement of a distracted driving traffic law means that a police officer can pull you over if they see you violating a distracted driving law, such as texting or using a hand-held cell phone. The police officer does not need another traffic offense to take place in order to pull you over. <p><strong>Fines for Violations of the Mass Hands-Free Law</strong></p>



<p>Until April 1, 2020, police will issue warnings to offenders of the new law. After this period, a violation of the law may result in a $100 fine for first time offenders. A second time offender may be issued a $250 fine and a third or subsequent offense may result in a $500 fine. Drivers committing a second or subsequent offense may be required to complete a distracted driving prevention program. Repeat violations may count as a surcharge on the driver’s insurance.</p>

From January to September 2019, an estimated 26,730 fatalities occurred in U.S. auto accidents, compared to 27,335 fatalities during the same January to September period of 2018. A 2.2% deduction in motor vehicle fatalities is reflected, despite vehicle miles traveled during this period having increased by 1%. <p>Motor vehicle accidents involving pedestrians have been on a sharp rise over the past decade throughout the country. In fact, pedestrian fatalities have increased 35% since 2008, compared to a 6% decrease in all other motor vehicle crashes in the same period. A recent report by the Governors Highway Safety Association estimates 6,227 pedestrians were killed on U.S. roads in 2018. Based on preliminary 2018 data, this is the highest number of pedestrian deaths due to <a href="/personal-injury/car-accidents/" target="_blank" rel="noopener noreferrer">car accidents</a> since 1990. Why are pedestrians in Rhode Island and the U.S. at such a high risk for getting killed by a car? Automobiles are safer than ever with the latest technology and innovative safety features including sensors that tell a driver when a person or another vehicle is too close. <p>Texting while driving has been illegal in Rhode Island for many years now and less than a year ago the state <a href="/news/ri-drivers-hands-free-law-effective-today-june-1st/">banned the use of hand-held devices while driving</a>. In an effort to promote the severity of distracted driving, Rhode Island State Police stopped 813 vehicles during a highway safety campaign last week issuing 93 warnings or citations to drivers for using cell phones for texting or making phone calls while operating a vehicle. <li>Prohibit your teen from riding with teen drivers or transporting other teens during the learning-to-drive process. One of the most dangerous sources of distraction for teen drivers is other teen passengers in the car. Rhode Island’s driver licensing rules allow no more than one non-family teen passenger under 21 for the first year of driving, unless supervised by an adult age 21 or older, sitting in the front seat, who has been licensed for at least five years.</li>

<strong>Graduated Drivers Licensing (GDL) Policy for New Rhode Island Drivers</strong></p>


<p>Rhode Island is one of a number of states with a graduated drivers licensing policy (GDL). <a href="https://www.dmv.org/ri-rhode-island/teen-drivers.php" rel="noopener noreferrer" target="_blank">Graduated drivers licensing</a> allows a new teen driver to gain experience by phasing in driving privileges prior to reaching a full privileged driver’s license.  During the process, they become more acclimated to operating a vehicle, varying road conditions, and safety rules. Phasing in driving privileges introduces new vehicle operators to the regular automobile population in a low-risk way that helps to protect others on the road, as well as themselves. A Rhode Island driver’s permit may be issued to a Rhode Island resident who is at least 16 years old, but less than 18 years old and has completed a certified driver education course and passed the DMV written test. The permit must be held for at least a period of six months during which time the driver may operate a vehicle only when accompanied by an adult aged 21 or older in the front seat with a valid driver’s license for at least five years.  Permit holders must complete 50 hours of supervised driving, with 10 hours completed at night. After passing a road test, a limited provisional license is issued with restrictions that the teen can drive unsupervised, except for between 1am and 5am. The driver may not drive with more than one passenger under the age of 21 for the first 12 months. A full operators license may be issued at age 17 and 6 months assuming the provisional license has been held for at least 12 months and no moving or seat belt violations have been issued in the past six months.</p>

<p>It’s a terrible tragedy no parent should ever have to experience. A 6-year-old Somerset, MA boy was involved in a <a href="http://www.providencejournal.com/news/20180724/boy-on-bicycle-struck-killed-by-car-at-bristol-bike-path-crossing" rel="noopener noreferrer" target="_blank">fatal crash</a> while on a leisurely bike ride with his family. The family was bicycling on the East Bay bike path on July 24<sup>th</sup>, when the fatal crash occurred at the intersection of the East Bay bike path and Poppasquash Road in Bristol, RI.<strong> </strong>A 21-year-old Connecticut driver collided with the young boy on his bicycle and some area residents are claiming poor visibility at the site may be to blame. <p><strong>Town of Bristol Had Been Warned </strong></p>



<p>A concerned citizen had warned the Bristol Town Administrators assistant four years ago via email about the poor visibility at the East Bay bike path and Poppasquash Road intersection where the tragic bike accident took place. The email spoke of several near crashes witnessed at the sight. With this email, Bristol was put on notice of a potentially dangerous problem. The question remains however whether even though the Town was alerted to the potential problem, did it properly address the safety issue and if so, did it continually maintain surveillance of the area to ensure its safety continued. The Town said at that time they worked to address the issue at the location by sending the Department of Transportation (DOT) to perform landscaping to improve visibility. Some nearby residents feel further safety measures need to be taken such as installing flashing lights and reducing the speed limit to make the intersection safer.</p>



<p><strong>Who is Responsible for Maintaining RI Bike Paths?</strong></p>



<p>In Rhode Island, the Rhode Island Department of Transportation (<a href="http://www.dot.ri.gov/" rel="noopener noreferrer" target="_blank">RIDOT</a>) is responsible for roadways and right of ways, but the Department of Environmental Management, or the town, are responsible for maintaining the bike paths. The East Bay Bike Path, constructed in phases between 1987 and 1992, is the first multi-town bike path built in Rhode Island and travels 14.5 miles. The RIDOT website states maintenance concerns with the bike path should be addressed to the Rhode Island Department of Environmental Management’s Division of Parks and Recreation.</p>



<p><strong>Rhode Island Bike Paths Will be Studied</strong></p>



<p>The RIDOT says it will conduct a safety study on the 200 intersections where bike paths cross with vehicle traffic. The study is expected to take 6 months. In the meantime, the brush has been cut back at the Bristol site making signs and the path easier to see. Temporary stop signs have also been placed by concerned citizens, which the Town of Bristol has approved for the time being. There is an existing regulation seven-foot-high stop sign on the path for bicyclists, however a sign at that height may be difficult for a child to see. From Memorial Day until back to school, thus begins the 100 deadliest days for summer driving involving teen drivers, according to <a href="https://www.tapinjury.com/news/over-400-road-related-fatalities-expected-this-memorial-day-weekend/" target="_blank" rel="noreferrer noopener">AAA.com</a>. Motor vehicle accidents are the leading cause of death for U.S. teenagers. Teenage drivers new to the road can be a risk every day of the year, but even more so once school is out. They are on the road more and are all too often the cause of car accidents. <p>Each year, thousands of people die in distracted driving accidents. All too often, these accidents are caused by cell phone use. As of today, June 1, 2018, a <a href="/news/rhode-island-bans-hand-held-cell-phones-driving/" target="_blank" rel="noreferrer noopener">new Rhode Island law</a> goes into effect banning the use of hand-held cell phones while driving. If you are already in the habit of not using a cell phone at all while driving, or <a href="/news/why-hands-free-devices-are-still-a-danger-while-driving/" target="_blank" rel="noreferrer noopener">using a hands-free device</a>, you are ahead of the game. However, for the 600,000 or so others that the National Highway Traffic Safety Administrations projected used a cell phone while driving in 2017, this is a new habit that will need to be learned quickly. <p><strong>What Does the New “Hands-Free Law” Mean for Rhode Islanders?</strong></p>



<p>As Rhode Islander drivers, we know this law has been in the works for a while. Now that June 1<sup>st</sup> has arrived, what exactly does this new law mean for those driving in Rhode Island? Drivers may still use cell phones while operating a vehicle, but they must be used in a hands-free capacity. Hands-free equipment may be a headset, earbud attachment, or a hands-free system installed within the vehicle. The following rules apply to RI drivers while the vehicle is in motion:

<li>Holding a cell phone to talk or listen is against the law.</li>



<li>Drivers may however, touch their phone to accept or reject an incoming call or to end a call.</li>



<li>It is not against the law to engage the map and navigation apps on a cell phone.</li>



<li><a href="/news/number-tickets-issued-texting-driving-rhode-island/" target="_blank" rel="noreferrer noopener">Texting or using email while driving</a> is currently, and remains, illegal in Rhode Island.</li>
</ul>



<p>
There are exceptions to the hand-held and texting laws which include use of a handheld device to seek assistance in an emergency situation.  There are also some professions which are exempt to these laws including on-duty law enforcement officers, firefighters, ambulance and emergency vehicle drivers.</p>

<p>Under this new law, first-time offenders may be given a $100 penalty. <p>Driving while distracted is of tremendous concern in Rhode Island and all over the U.S. In honor of Distracted Driving Awareness Month this April, Tapalian Law wants to help spread the message that we already know but need frequent reminding of- <a href="https://www.tapinjury.com/news/april-distracted-driving-awareness-month/" target="_blank" rel="noreferrer noopener">Just Drive</a>. According to the <a href="https://www.nhtsa.gov/" target="_blank" rel="noopener noreferrer">National Highway Traffic Safety Administration (NHTSA)</a>, close to 3,500 people were killed in distracted driving crashes in 2015. This number in actuality is likely higher as police reports often do not fully list a reason for a car crash. As Providence personal injury lawyers, we see the full extent of these tragic vehicle fatalities as well as the personal injury that can accompany victims involved in the accident. <h3 class="wp-block-heading" id="h-hands-free-does-not-mean-safe-driving"><strong>Hands-Free Does Not Mean Safe Driving</strong></h3>



<p>In June 2018, it will be <a href="https://www.tapinjury.com/news/rhode-island-bans-hand-held-cell-phones-driving/" target="_blank" rel="noreferrer noopener">against the law to use a hand-held cell phone while driving in Rhode Island</a>. Hands-free devices will be allowed. But here’s the trouble. “The human brain cannot handle two thinking tasks at once”, states an article posted on the National Safety Council website. The human brain has to switch back and forth between the two thinking tasks and the job of talking and driving is a prime example. We all think we are expert multi-tasker’s and “it won’t happen to me”, but the truth is our brains simply are incapable of performing two thinking tasks at the same time. So, if we are talking while driving, whether using a hand-held phone or a hands-free device, we are focusing on what is being said during the phone conversation and not fully on the road. Inattentiveness to the road is an easy way to cause an accident with another car, a pedestrian, a bicyclist, or even hitting something as simple as a mailbox. A distraction while driving may range from minor, such as swerving into another lane where there is no other vehicle, or major, like hitting a pedestrian in a crosswalk resulting in a fatal injury. Driving while using a cell phone, auto infotainment system, or GPS, can be classified as types of inattentional blindness. Inattentional blindness, also called perceptual blindness, is a lack of attention that is not associated with any vision defects. It may involve an event in which the individual fails to perceive an unexpected stimulus although it is in plain sight. A driver sending a text may miss a stop sign that is clearly visible. The driver has no vision deficits and the stop sign is in clear view, however the person’s brain is focused on composing the text and not on their driving causing them to miss the stop sign. Using a cell phone often leads to inattentional blindness and psychologists are more frequently finding a correlation between inattentional blindness and distracted driving.  Many of us credit ourselves as being skilled multi-tasker’s. But the fact of the matter is although we may be able to handle multiple tasks simultaneously, we can not perform them all as well as if we did one task at a time. And when you consider a task like driving an automobile where it only takes a few short seconds to take a person’s life, multi-tasking should not even be a consideration.

<h3 class="wp-block-heading" id="h-avoid-distracted-driving"><strong>Avoid Distracted Driving</strong></h3>



<ul class="wp-block-list">
<li>Use technology to block calls and texts from coming in while driving.</li>



<li>Turn off your phone ringer while driving and put your phone where it cannot be reached, like the backseat.</li>



<li>Eating, drinking, grooming should not be done while driving.</li>



<li>Adjust any music or GPS systems prior to beginning a drive.</li>



<li>Be mindful, be present while driving.</li>



<li>As the campaign says- just drive. Rhode Island is part of the “Just Drive New England” initiative to enforce and educate the public of the dangers of distracted driving. In an effort to promote National Distracted Driving Awareness month this April, Rhode Island joined forces with nine other Northeastern states as well as Puerto Rico and the U.S. Virgin Islands in the “Just Drive New England” initiative. This campaign will utilize enforcement and education to inform the public of the extreme dangers of distracted driving. Distracted driving can take place in many forms. It may be using a cell phone to talk, text, or send an email, applying makeup, adjusting a music station, chatting with passengers, amongst other distractions while operating a motor vehicle. Driving distracted can be as deadly as drunk driving, speeding, or aggressive driving, according to the Rhode Island State Police. The goal of the “Just Drive New England” campaign is to inform and educate drivers of these dangers and change their driving habits. The <a href="https://www.nsc.org/road-safety/get-involved/distracted-driving-awareness-month" rel="noopener noreferrer" target="_blank">National Safety Council</a> shares further information on their website about distracted driving and the “Just Drive” initiative.

<h3 class="wp-block-heading" id="h-rhode-island-t-raffic-fatalities-up-63"><strong>Rhode Island T</strong><strong>raffic Fatalities Up 63%</strong></h3>



<p>Rhode Island automotive fatalities are at their highest since 2008. In a recent <a href="/news/rhode-island-traffic-fatalities-63-2017/" target="_blank" rel="noreferrer noopener">Tapalian Law blog</a>, we explored the top causes of fatal car accidents across the country which are speeding, drunk driving, and distracted driving.
