<p>A fatal bicycle accident in Newport last week left locals of the Rhode Island city in mourning, and also upset. Kayla Watson, a 34-year-old Middletown resident, was killed while riding an electric bike to work on Admiral Kalbfus Road. Watson was <a href="https://www.newportri.com/story/news/accident/2023/10/12/middletown-woman-killed-in-newport-crash-identified-as-kayla-watson/71153406007/" rel="noopener noreferrer" target="_blank">fatally injured</a> after being struck by a bucket truck at an intersection on a stretch of road notoriously known for being dangerous.  The intersection where Admiral Kalbus Road and Hillside Avenue meet has been the subject of a number of safety studies over the years which have shown a “general neglect for traffic safety laws”, including frequent speeding and running red lights. <p>Just this summer, a group of area residents voiced their concerns and requested safety improvements to the Newport City Council, RI Department of Transportation, and state and national officials in an 18-page letter. While the intersection has been a long-time traffic safety concern, residents’ uneasiness escalated when the RIDOT Pell Bridge ramp realignment project resulted in a big influx of commercial and construction vehicles being re-routed through the area. Considered part of Route 138, a larger state highway, Admiral Kalbus Road is also a residential area. Hillside Avenue is also a residential area and a main route to and from Newport’s Pell Elementary School which is of great concern to both parents and neighbors who frequently observe motorists driving with a disregard for speed limits and traffic signals.</p>


<p>Over time the city has made improvements such as installing signage on Hillside Avenue and trying to use speed cameras. In fact, the city was awarded a $230,000 federal grant in 2022 for traffic safety measures on Hillside Drive following a traffic study conducted the prior year which showed continued speeding and pedestrian safety issues. In late 2022, cameras were used to catch 67 vehicles speeding through the intersection. The issue of the speed camera’s contract, however, was removed from the city council’s summer agenda leaving residents frustrated and worried.</p>


<p><strong>City Urged to Make Changes</strong></p>


<p>After the fatal bike accident, locals are putting pressure on Newport officials to redirect the influx of commercial vehicles away from the residential and school area and instead toward a new roundabout in the city and urging the city to install the speed cameras. Making improvements may prove a bit more complex with some portions of the roads in question being managed by the State of Rhode Island DOT while other portions belong to the city. In addition to these changes, local groups such as Bike Newport are advocating for long-term measures such as a designated bike path to improve safety for those biking, walking, and driving,</p>

<p>An unfortunate series of pedestrian accidents in Providence and elsewhere in Rhode Island this year have brought to light the question of whether or not pedestrians are safe crossing the street in the state. Circumstances surrounding each incident are different, yet each had a tragic outcome. A driver in Westerly who hit and killed a pedestrian was accused of drunk driving. On North Main Street in Providence, a female motor vehicle operator hit a pedestrian and fled the scene; the man died and the driver was tracked down using local video footage. Near the state house, a well-known local, Superior Court Judge Richard Licht, was seriously injured by a car while walking across Smith Street. <p>In 2020, Rhode Island experienced 17 pedestrian fatalities, according to the most recent data provided by the National Highway Traffic Safety Administration (<a href="https://www.nhtsa.gov/" rel="noopener noreferrer" target="_blank">NHTSA</a>). Based on the number of total traffic fatalities that year, 67 traffic accident-related deaths, pedestrians accounted for 25.4% of the total traffic fatalities in Rhode Island. Clearly, the safety of those on foot is a concern.</p>


<p>Across the United States, the NHTSA provides the following <a href="https://crashstats.nhtsa.dot.gov/Api/Public/ViewPublication/813310" rel="noopener noreferrer" target="_blank">data</a> for the year 2020:

<li>Not surprisingly, over ¾ of pedestrian fatalities occur in the dark, a majority taking place between the hours of 6pm-8:59pm.</li>
<li>Alcohol use (driver, pedestrian, or both) is a contributing factor in almost half of all pedestrian deaths.</li>
<li>More pedestrians are killed in urban areas (82%), than rural areas (18%).</li>
<li>Only 15% of pedestrian traffic fatalities take place at intersections.</li>
</ul>

<strong>Are Crosswalks a Safe Option?</strong></p>


<p>Pedestrians are urged to always use a designated crosswalk when attempting to cross a street. Of course, there is no guarantee of safety but there is definitely a benefit. According to <a href="http://webserver.rilin.state.ri.us/Statutes/TITLE31/31-18/31-18-3.htm" rel="noopener noreferrer" target="_blank">Rhode Island General Law 31.18.3,</a> the driver of a vehicle must yield the right of way and allow a pedestrian within a crosswalk, or approaching closely, to safely cross.  Despite the law, not all drivers heed it and most of us have seen dangerous near-collisions between cars and people crossing the street. Reckless drivers may be distracted by a text or phone call, while others carelessly choose to ignore the requirement and plow right through a crosswalk without even attempting to look for people on foot. <p>It may go without saying, but when a motor vehicle collides with a pedestrian, in the majority of cases, the pedestrian is going to be the loser in this battle. When the vehicle involved in the collision is an SUV, the stakes are even higher and the risk and severity of the injuries suffered by the unprotected victim are typically much worse. As a Rhode Island personal injury attorney, David Tapalian has seen serious and often life-threatening injuries occur when a person on foot is hit by a moving vehicle. Frequently, the extent of the injuries the person suffers, and their risk of death, corelates to the size of the SUV or truck.  A <a href="https://www.iihs.org/news/detail/new-study-suggests-todays-suvs-are-more-lethal-to-pedestrians-than-cars" rel="noopener noreferrer" target="_blank">study</a> last year by the Insurance Institute for Highway Safety (IIHS) backed up this assumption when it looked at which vehicles were more dangerous in pedestrian <a href="/personal-injury/car-accidents/" rel="noopener" target="_blank">car accidents</a> and reported that sports utility vehicles were found to kill and injure <a href="/personal-injury/pedestrian-injuries/" rel="noopener" target="_blank">pedestrians</a> more frequently than other types of cars.
<strong>IIHS Study Findings</strong></p>


<p>Considering that SUVs make up <a href="https://www.nytimes.com/2020/05/21/business/suv-sales-best-sellers.html" rel="noopener noreferrer" target="_blank">almost 50%</a> of motor vehicle sales in the U.S. each year and are projected to continually rise, and sedans make up less than a quarter of sales, the study findings are daunting.  The primary difference between getting hit by a smaller vehicle versus a sports utility vehicle occurs when a collision takes place at an intermediate speed. For example:

<li>When traveling at 40 miles per hour:
<ul>
<li>A car hitting a pedestrian will result in death 46% of the time.</li>
<li>An SUV traveling at the same speed will kill a pedestrian almost 100% of the time.</li>

Based on the IIHS findings, when the vehicle traveled at lower or higher speeds, there was less of a difference between the danger of SUV’s and cars. One reason SUV crashes are riskier to pedestrians is because of the traditional SUV’s more “boxy” shape in front. The resulting <a href="/personal-injury/car-accidents/injuries-from-a-car-accident/">injuries</a> caused by the larger vehicle’s bumper, headlights, and grill are more damaging because they are higher off the ground and these parts of the vehicle typically hit a person’s chest or pelvis as opposed to just their lower extremities. This style of vehicle is also more likely to throw a person forward than a smaller, differently designed car is.</p>


<p><strong>What Vehicle Manufacturers Are Doing </strong></p>


<p>Over the years, a number of auto manufacturers have revamped the designs of their sports utility vehicles to be more car-like and feature a more sloped front bumper. Although other manufacturers began lowering bumpers and other heavy parts, the rate of accidents has not significantly decreased because the location of the parts is not as damaging as the actual shape of the front of the car. The IIHS says that manufacturers need to do more to combat these design issues that have resulted in pedestrian injuries and deaths, especially with the popularity of sports utility vehicles on the road.</p>

Despite drivers in Rhode Islander driving fewer miles, surprisingly the state has seen a <a href="https://www.providencejournal.com/story/news/local/2020/10/29/ri-sees-concerning-trend-fatal-crashes-some-blame-covid/6069064002/" rel="noopener noreferrer" target="_blank">“concerning”</a> uptick in traffic fatalities and serious car accidents this year. Some stroll or jog for exercise, walk to school, to work, or to pick up lunch. Others are walking the dog or pushing a stroller. During the months of September to February, over 30% of pedestrian fatalities occur between the hours of 6:00pm and 8:59pm, according to the NHTSA.</p>

If neither is available, cross at a well-lit area with a good view of traffic coming both ways and wait for a safe gap in traffic before crossing.</li>



<li>Wear bright colors during the day, and reflective materials at night. Use a flashlight at night for extra visibility. Make eye contact with drivers to ensure you are seen.</li>



<li>Be alert to cars entering, exiting, or backing up in driveways or parking lots.</li>

<li>Be alert for pedestrians at all times when driving. Be extra cautious when visibility is lessened, such as night time and during poor weather conditions.</li>

<li>Always yield to pedestrians in a crosswalk. Leave plenty of room for them and for other vehicles to see and stop for them.</li>



<li>Follow the speed limit, especially in areas where there are people around. Use extra caution and slow down in school zones and neighborhoods with children present.</li>

<p>The great majority of us use a cell phone on a daily basis and most of us walk someplace too, whether to pick up a child at the bus stop, a lunch break to pick up a sandwich, or walking the dog. Often, this walking time is used to check email, peruse social media, or send a quick text. A good way to multi-task while getting some exercise? Perhaps. But lately it’s become riskier as a <a href="https://www.cnn.com/2020/02/03/health/texting-pedestrian-safety-study-wellness-scli-intl/index.html" rel="noopener noreferrer" target="_blank">recent study</a> shows that using your phone as you walk is more dangerous, and likely to cause an accident, than listening to music or even talking on the phone. <p><strong>Be Alert as a Pedestrian </strong></p>


<p>Over 6,000 pedestrians were killed in the U.S. in 2018. This is the highest number in more than 20 years, according to the Governors Highway Safety Association <a href="https://www.ghsa.org/" rel="noopener noreferrer" target="_blank">(GHSA)</a>. While this recent study may be small and need more in-depth research, the issue of distracted walking and <a href="/personal-injury/car-accidents/types-of-car-accidents/distracted-driving-accidents/" rel="noopener noreferrer" target="_blank">distracted driving</a> is big. While innovations in safety technology have increased the survivability of victims in automobile crashes, pedestrians still remain susceptible to critical, or fatal, injuries when hit by a vehicle.</p>

<p><em>Study Findings</em></p>


<p>The study, by researchers at the University of Calgary, analyzed the cause behind hundreds of pedestrian incidents. Throughout the study, texting while walking was associated with a higher rate of mishaps, like a failure to look left and right when crossing the road, and near-misses. Those listening to music did not seem to be affected while those talking on a cell phone had a small risk.</p>


<p><strong>What Has Contributed to A Rise in Pedestrian Accidents?</strong></p>


<p>There are a number of factors that affect the rate of pedestrian accidents and deaths each year and the latest research points to smartphones as a significant contributor. <a href="/personal-injury/car-accidents/types-of-car-accidents/car-accidents-related-to-cell-phones/" rel="noopener noreferrer" target="_blank">Cellphone distractions</a> in these scenarios can be attributed to both the motorist driving the vehicle who hits the pedestrian, as well as the pedestrian who is distracted by looking at their cell phone. An accident could arise as a result of the driver, the pedestrian, or a combination of both. For example, the driver of a car may be using a phone to send a text while driving and collide with a pedestrian who is walking across the street looking down while texting a friend. As the prevalence of electric scooters has increased in cities like Providence RI, so have the scooter injuries in these cities. <p>The City of Providence’s decision to remove a recently installed bike lane on Eaton Street has cyclists in Rhode Island up in arms. Providence’s first two-way bike lane, newly completed in early September of this year at a cost of over $63,000, will be dismantled amid concerns and complaints by local residents, for an additional cost of $64,000. Rhode Island bicyclists may have good reason to be upset. The majority of <a href="/personal-injury/other-vehicle-accidents/bicycle-accidents/" target="_blank" rel="noopener noreferrer">bike accidents</a> occur in urban areas and as bicycle accident lawyers, we know one of the best ways to ensure safety for bicyclists is to have designated, safe cycling lanes. Clearly identified and designated bike lanes are essential to ensure safety for vulnerable cyclists and were included in the City’s “Great Streets Initiative” which proposed 60 mikes of bike lanes, including the new lane on Eaton Street.</p>

<p>Buying a new car today requires a lot of research, not just to review safety scores and dependability, but to choose from the myriad of safety options and technology that are available. A number of safety features now come standard when purchasing a new vehicle, such as back-up cameras required in all new vehicles effective May 2018, but other options will bump up the sticker price quite a bit.  While some auto buyers won’t mind the price jump if they feel they are getting the most advanced safety and technology features out there, other buyers will be deterred by the costly options. <p>With all of the cutting-edge safety technologies available, some critics still think not enough is being done to keep drivers and <a href="/personal-injury/pedestrian-injuries/" target="_blank" rel="noopener noreferrer">pedestrians</a> safe from car accidents. <p><strong>Increase in Pedestrian Deaths</strong></p>



<p>Despite over $80 billion spent on “smart”, connected, and autonomous vehicles, over 6,000 pedestrians were killed in the U.S. in 2018 alone. Pedestrians accounted for over 25% of Rhode Island traffic fatalities in 2017. Some say safety measures, like radio-frequency tags that emit a signal that can be detected by cars, should be taken by pedestrians and bicyclists. Is this only putting the onus on pedestrians to keep away from cars, and not the other way around? As a RI personal injury lawyer, Attorney David Tapalian knows that safety goes both ways and the responsibility must be shared by both drivers and pedestrians. The majority of driver distractions are caused by cell phone use, texting and driving, and other technology. Ironically, in-vehicle technology meant to improve safety can be a huge distraction to motor vehicle operators. Bigger, and more complex, dashboards compete for driver’s attention, taking it away from the road. The popularity of bigger vehicles, specifically sports utility vehicles, has led to a huge increase in single-vehicle pedestrian deaths involving SUV’s, according to the Insurance Institute for Highway Safety (IIHS). Due to an SUV having a higher front end than the average car, it is twice as likely than a car is to kill a walker, runner, <a href="/personal-injury/other-vehicle-accidents/bicycle-accidents/" target="_blank" rel="noopener noreferrer">bicyclist</a>, or child.</p>



<p><strong>What Are Some Solutions?</strong></p>



<p>There is no quick or easy solution to reduce the number of deadly car accidents. However, Ms. Arieff offers up some potential solutions, first of which is that we all drive less. Not only will this lessen environmental pollution, but it will also lessen the number of auto accident fatalities and injuries. Other ideas she proffers are reducing speed limits, eradicating right turns on red, and adding protected bicycle lanes. Its focus is to reduce the “national automobile fuel economy and greenhouse gas emissions standards”, make newer, safer cars more affordable, and ultimately reduce car accident related injuries and save up to 1,000 lives annually. Just last month, the first steps were taken towards finalizing the proposal.</p>

<p>With the arrival of Spring, electric scooters abound in Providence. Electric scooters, also known as e-scooters, are still new to the downtown scene having only arrived to cities nationwide in 2018. Being in their relative infancy, e-scooters and their safety have not yet been studied extensively. As personal injury lawyers in Providence, we know that like a pedestrian or bicyclist, sharing the road with cars and trucks in such close proximity poses a huge safety risk, especially to riders not protected by a helmet.  Although the guidelines outlined in the Providence <a href="http://www.providenceri.gov/planning/e-scooter-share-pilot-program/" rel="noopener noreferrer" target="_blank">E-Scooter Pilot Program</a>, include the need for riders to obey traffic laws and encourage riders to wear helmets, plenty of electric scooters can be seen zipping around the city driving recklessly and unfortunately, most riders are not wearing a helmet.  Marked by a rise in serious injuries to e-scooter users, especially first-time users, this safety concern was the catalyst for a recent <a href="http://www.austintexas.gov/edims/pio/document.cfm?id=318777" rel="noopener noreferrer" target="_blank">study</a> conducted by the Centers for Disease Control and Prevention (CDC) and Texas’ Austin Public Health Department to find out why there is such a high prevalence of injuries among electric scooter operators.</p>


<p><strong>What Prompted the Investigation into E-Scooter Injuries?</strong></p>


<p>A considerable rise in emergency room visits for users and pedestrians prompted Austin, Texas city leaders to request an investigation by the CDC into scooter-related crashes and injuries. Seeking alternative modes of transportation in the big city, especially emission-free transportation, Austin residents took to the streets when the e-scooters arrived. Following this, emergency rooms in the area began to notice a large number of visits from electric scooter drivers with broken bones and head injuries. The ER visits included injuries both minor and major, such as a University of Texas student, a star baseball shortstop, that missed his season after he hit a pothole riding an electric scooter tearing his Achilles tendon and requiring surgery. In January 2019, Austin experienced its first <a href="https://www.cnn.com/2019/03/04/health/scooter-injury-cdc-investigation-partner/index.html" rel="noopener noreferrer" target="_blank">scooter related death</a> when a 21-year-old University of Texas student died a day after suffering critical injuries after his electric scooter collided with a car.</p>


<p><strong>High Rate of Injury Among First-Time Electric Scooter Users</strong></p>


<p>The CDC report found an especially high rate of injury among new e-scooter riders, specifically one in three injured riders were hurt on their first trip. Almost half of the hurt riders had head injuries, only one of them was wearing a helmet. As Providence personal injury attorneys, Tapalian Law urges all electric scooter and bicycle riders to wear a helmet to reduce the risk of head injury or brain injury. The most common injuries among scooter riders were broken bones, especially arms, wrists, and legs.</p>


<p>The study, performed among 190 e-scooter riders injured between September and November 2018, claims its findings may be highly underestimated as it only interviewed injured scooter riders who visited a local emergency room. It did not include injured riders who visited a doctor’s office, urgent care facility, or chose not to seek any medical treatment. Not only are scooter operators getting hurt, but pedestrians are getting injured by moving scooters or tripping over scooters left carelessly on the sidewalk. Though the study was confined to emergency room visits in Austin, it led researchers to conclude that more training is needed for e-scooter riders.</p>


<p><strong>Why Are E-Scooters Dangerous?</strong></p>


<p>The main reason e-scooter operators are getting injured so often is inexperience. Lack of experience in novice users, and not following safety rules set out by the scooter companies, creates a great safety risk to both users as well as pedestrians and other cars and trucks on the road. Just like a motor vehicle driver, driving aggressively, speeding, using a cell phone, and driving intoxicated all increase the risk of injury to an electric scooter user.  It is extremely risky to operate a scooter without a proper helmet and doing so greatly increases the risk of brain or <a href="/personal-injury/head-injuries/" rel="noopener noreferrer" target="_blank">head injury</a> if a driver is involved in a collision.  Poor road conditions like potholes, can contribute to scooter accidents as can adverse weather conditions. Cars, trucks, and SUV’s also pose a risk to e-scooters on the road. Getting hit by a car or side-swiped by a truck, whether accidentally or with negligence, is significantly more dangerous to those riders not wearing a helmet. Pedestrian injuries include tripping over scooters parked or left carelessly on the street and getting hit by moving e-scooters.</p>


<p><strong>What is Being Done to Make Electric Scooters Safer? </strong></p>

Providence scooter companies Bird and Lime, both part of the city’s E-Scooter Share Pilot Program, have expressed their commitment to rider and community safety. Bicycle crossings have been installed by the Rhode Island Department of Transportation (RIDOT) at various busy intersections and “Sharrows”, symbols painted on the road with the symbol of a cyclist with arrows, were installed to remind drivers to share the road with bicyclists. After the death of the young boy in Bristol, RIDOT vowed to review every spot where dedicated bike paths cross roads. The Rhode Island Department of Environmental Management (RIDEM) is responsible for maintenance issues along the bike path and Rhode Islanders are encouraged to contact them with maintenance concerns like shrubbery overgrowth.</p>


<p><strong>Bicyclist Road Fatalities in Rhode Island</strong></p>


<p>Over 800 people were killed in 2015 in the U.S. in crashes involving a bicycle and motor vehicle, according to the <a href="https://www.nhtsa.gov/" rel="noopener noreferrer" target="_blank">National Highway Traffic Safety Administration (NHTSA)</a>. <p>Providence residents were in for a surprise this summer when in mid-July, dozens of electric scooters showed up on the streets of Providence unannounced. With the newfound popularity of electric scooters to navigate cities like San Francisco, it was just a matter of time before the vehicles hit the streets of Providence. <a href="https://www.bird.co/" rel="noopener noreferrer" target="_blank">Bird</a>, the California company responsible for bringing the scooters to Providence, say they want to offer affordable, environmentally friendly vehicle options to communities.  The easily accessible vehicles, available through an app for $1 plus .15/minute, were a novelty with many interested in trying them if not just for the curiosity factor. But, just as quickly as they appeared and local residents got used to seeing them around, the scooters disappeared just a few weeks later due to a lack of regulation by the city. Bird says they plan to return to Rhode Island as soon as they comply with new regulations set forth by the city.</p>


<p><strong>Inexperienced Drivers Often Cause Accidents Resulting in Personal Injury </strong></p>


<p>While many view rental scooters as a welcome and environmentally friendly addition to cities, others have some concerns. Cities where rentals are currently offered have seen a spike in emergency injuries to riders, as well as pedestrians. The main cause for the injuries is inexperienced scooter operators. In addition, operators of the scooters are often wearing earbuds which can make them oblivious to traffic and pedestrians around them, adding to the potential for injury. <p><strong>Providence City Regulations for Scooters</strong></p>


<p>The reason the scooters disappeared in Providence? Bird had not been authorized by the Department of Public Works and had not received permission to be in the city. Bird voluntarily removed their vehicles and <a href="http://www.providencejournal.com/news/20180815/bird-scooters-gone-from-providence-for-now" rel="noopener noreferrer" target="_blank">the city is currently establishing regulations for the scooter company</a> to comply with such as:

<li>Maximum number of scooters available for rent will be 300.</li>
<li>Scooters will be distributed throughout 5 city zones.</li>
<li>Rental companies, such as Bird, must accept all liability for loss related to the use of the scooters and provide the city with an insurance policy of at least $1 million.</li>
</ul>

<p>
Some cities have already banned the use of scooters, such as Cambridge, MA, while others are providing a trial period for the vehicles to see what effect their usage has on traffic and safety and what regulations need to be put into place.</p>

This campaign will utilize enforcement and education to inform the public of the extreme dangers of distracted driving. Distracted driving can take place in many forms. It may be using a cell phone to talk, text, or send an email, applying makeup, adjusting a music station, chatting with passengers, amongst other distractions while operating a motor vehicle. Driving distracted can be as deadly as drunk driving, speeding, or aggressive driving, according to the Rhode Island State Police. The goal of the “Just Drive New England” campaign is to inform and educate drivers of these dangers and change their driving habits. The <a href="https://www.nsc.org/road-safety/get-involved/distracted-driving-awareness-month" rel="noopener noreferrer" target="_blank">National Safety Council</a> shares further information on their website about distracted driving and the “Just Drive” initiative.

<h3 class="wp-block-heading" id="h-rhode-island-t-raffic-fatalities-up-63"><strong>Rhode Island T</strong><strong>raffic Fatalities Up 63%</strong></h3>



<p>Rhode Island automotive fatalities are at their highest since 2008. <p>Nearly 40,000 lives are lost each year due to traffic accidents in the United States. Rhode Island traffic fatalities alone were up 63% last year. Close to 94% of these fatal crashes are caused by distracted driving and human error. Proponents of self-driving cars claim that autonomous vehicles can greatly reduce the amount of traffic related deaths and accidents by removing these common causes. However, after a <a href="https://www.nbcnews.com/tech/innovation/self-driving-uber-car-involved-fatal-accident-arizona-n857941" rel="noopener noreferrer" target="_blank">pedestrian was killed in March by an Uber self-driving car</a> in Tempe, Arizona, opponents are raising questions about the safety of these autonomous vehicles. <p><strong>How Do Self-Driving Cars Work?</strong></p>



<p>Previously we posted a Tapalian Law <a href="/news/self-driving-cars-road-sooner-think/" target="_blank" rel="noreferrer noopener">personal injury blog</a> delving into how self-driving vehicles operate and some concerns surrounding them. We explained an autonomous vehicle works by utilizing a combination of sensors, cameras, radars, and lasers to detect and adjust to road conditions as well as other vehicles on the road. With technology improving daily, updates are constantly being made to the accuracy of these systems. Seemingly, an autonomous vehicle removes the issue of human error and distractions while driving. Alas, issues and concerns still remain like how the autos will react in various weather conditions and recognizing a pedestrian versus a face on a billboard or advertisement.</p>



<p>In the Uber accident however, it appears neither the vehicle itself nor the Uber safety driver in the car detected the pedestrian in the road prior to the crash. Video shots show the safety driver looking down and without their hands hovering about the steering wheel, as they are trained to be positioned in order to quickly divert a potential crash. Police state the Uber car never slowed down before hitting the 49-year old Arizona woman pushing a bicycle across the road.</p>



<p><strong>What Has Changed Since the Pedestrian Accident?</strong></p>



<p>Eight days after the fatal pedestrian crash, Arizona state officials ordered Uber to suspend its autonomous vehicle testing program in the state. Officials claim that Uber failed to prioritize public safety throughout the testing process, as was expected of them. After the incident, Uber ceased testing of its self-driving vehicles at its own will in Arizona, San Francisco, Pittsburgh, and Toronto. Uber also did not renew its permit to test self-driving cars in the state of California.</p>



<p><strong>More Accidents Inevitable?</strong></p>



<p>Advocates of self-driving cars say they need to be kept on the road in order to continue testing and perfecting the vehicles. The sooner all the malfunctions and glitches are worked out, the sooner these self-driving cars can begin to reduce the amount of traffic related deaths, accidents, and personal injury caused by car crashes. Challengers say more accidents and deaths from autonomous vehicles are inevitable and feel manufacturers need to use extra caution before allowing the cars on public roads. <a href="https://www.nytimes.com/2018/03/23/technology/uber-self-driving-cars-arizona.html" rel="noopener noreferrer" target="_blank">Others blame Uber</a>, saying that Uber’s autonomous vehicles are not operating as well, or as safely, as its competitors like Waymo and Cruise.</p>



<p><strong>Distracted Driving Still a Problem with Self-Driving Vehicles</strong></p>



<p>Ultimately, it would seem driverless cars are exactly that, without a driver. But during testing modes manufacturers tend to have either one or two safety drivers in the vehicle depending on the circumstances and location. The purpose of the safety driver is to prevent a potential accident that is missed by the self-driving car. Since we cannot rely completely on driverless cars as there are still many issues to be worked out, a safety driver is necessary at this time. Ironically, it seems the safety driver was distracted in this accident, which doesn’t make the autonomous vehicles any safer than our fully driver-operated vehicles where we are easily prone to distractions and human error, both of which cause a huge amount of traffic related deaths and personal injury. Uber has some work to do and self-driving car manufactures have much to prove before these vehicles can be fully trusted on their own.</p>

In addition to awareness programs bringing attention to drunk driving and distracted driving, the <a href="https://www.nhtsa.gov/" rel="noopener noreferrer" target="_blank">National Highway Safety Traffic Administration (NHTSA)</a> is fervently promoting motor vehicle technologies that can potentially reduce the number of crashes caused each year that result in death and personal injury. We often hear about these new automobile technologies, but the choices can be overwhelming and confusing, especially if you are not a technology buff. <h3 class="wp-block-heading" id="h-automatic-emergency-braking-systems-aeb"><strong>Automatic Emergency Braking Systems (AEB)</strong></h3>



<p>
<u>How They Work</u>: Automatic Emergency Braking Systems, also called AEB, use a combination of sensors to detect an impending forward crash with another vehicle in time to avoid, or reduce, the effects of the crash.  Once an impending crash is sensed, the first step in the system is to alert the driver, (possibly by sound, display on the dashboard, or both), to take corrective action. If the driver does not take action to avoid the crash, the AEB system may take over and automatically apply the brakes to prevent or diminish the impact of the crash.</p>



<p>One-third of all police reported crashes in 2012 involved a rear end collision with another vehicle. Vehicles equipped with an AEB system could potentially prevent and lessen the severity of these common rear-end crashes, and corresponding injury, that we see so often as RI personal injury attorneys. NHTSA research shows that a number of these currently available systems are prove to be capable of avoiding or diminishing the severity of rear-end crashes in particular situations.
</p>



<h3 class="wp-block-heading" id="h-pedestrian-automatic-braking-system-paeb"><strong>Pedestrian Automatic Braking System (PAEB)</strong></h3>



<p>
<u>How They Work</u>: Similar to AEB systems, the Pedestrian Automatic Braking System (PAEB), uses a combination of sensors and cameras to detect a pedestrian in danger of being hit by a forward moving vehicle. The system will first alert the driver to the pedestrian and if appropriate action isn’t taken by the vehicle operator, the PAEB system will automatically apply the brakes in hopes of avoiding hitting the pedestrian. The PAEB system is also known as frontal pedestrian impact mitigation braking.</p>



<p><a href="/personal-injury/pedestrian-injuries/" rel="noopener" target="_blank">Pedestrian accidents</a> often occur when a pedestrian is crossing the street in front of a vehicle. Pedestrian crashes are most frequent when a vehicle is heading straight and a pedestrian is crossing the road; turning right or left and a pedestrian is crossing the road; or heading straight and a pedestrian is walking alongside or against traffic. The NHTSA recognizes this technology as a potentially life-saving feature that may be added to the list of recommended technologies down the road.
</p>



<h3 class="wp-block-heading" id="h-backup-cameras-rearview-video-systems"><strong>Backup Cameras (Rearview Video Systems)</strong></h3>



<p><u>How They Work</u>: Backup cameras provide an image of the area behind the vehicle to the driver to act as a so-called “second set of eyes” to view what is behind the vehicle. This technology is extremely helpful in preventing <a href="/news/preventing-backover-accidents-backup-cameras-mandatory-may-2018/" target="_blank" rel="noreferrer noopener">backover accidents</a> whose victims are most commonly children and senior citizens. When the vehicle operator shifts into reverse, an image of behind the vehicle is displayed in the dashboard or rearview mirror, depending on the type of car, SUV, or truck.</p>

<p>Rhode Island traffic fatalities are at their highest since 2008, with 83 traffic related fatalities seen in the state in 2017. This is a jump from 51 traffic deaths seen in 2016 and 2014 in Rhode Island. Ironically, 2015 saw the lowest number of traffic fatalities in RI, 45, since 1992 according to the <a href="https://www.nhtsa.gov/" rel="noopener noreferrer" target="_blank">National Highway Traffic Safety Administration</a> (NHTSA). With increased auto safety features and public awareness campaigns about safer driving practices, one would expect to continually see a decrease in injuries and deaths from car accidents each year. So, it is alarming to see an uptick of 63% in just one year. Though we can not predict if this will realize a decrease in traffic fatalities, it may bring extra awareness to the serious issue of distracted driving.</p>



<h3 class="wp-block-heading" id="h-auto-related-deaths-across-the-country"><strong>Auto Related Deaths Across the Country</strong></h3>

Nationally, 2017 saw an increase in traffic fatalities all over the country. The NHTSA released data in October 2017 showing that almost 37,500 people lost their lives to auto accidents in 2016, which was an increase of 5.6 percent from 2015. Speeding related deaths increased by 4% and deaths due to failure to wear a seat belt were up 4.6%. Pedestrian deaths saw their biggest jump since 1990, increasing 9%. Deaths caused by alcohol impairment also jumped in 2016. In response to this increase, Rhode Island State Police launched a moving campaign to address drunk driving prior to the beginning of 2017. The campaign, “#BeyondtheCrash”, showed RI state troopers discussing the trauma inflicted by driving under the influence.
