Texting while driving is already banned in Massachusetts and Rhode Island as well as many other states, but will hand held cell phone use follow behind? It may soon, at least in Massachusetts. If passed, it would join neighboring Connecticut, New Hampshire, Vermont, and New York in banning the use of hand-held cellphones by motorists. This isn’t the first time the bill has been proposed in Massachusetts and although already approved by the Senate, it still has a way to go before becoming law. The auto accident attorneys at Tapalian Law agree this is a positive move on the road to reducing auto accident fatalities and injuries. Although texting while driving is already banned in Massachusetts and Rhode Island, we still see clients in our Providence, RI, and Seekonk, MA offices every day suffering from car accidents caused by distracted driving, like texting, that have caused them serious personal injury, time lost from work for doctor’s visits, medical expenses, and pain and suffering.

Bill Aims to Reduce Distracted Driving

According to the National Highway Traffic Safety Administration, distracted driving took nearly 3,500 lives in the United States in 2015. This bill would aim at helping to reduce deaths caused by distracted drivers, as well as car accidents resulting in other types of injuries and property damage. Currently, 46 states have banned texting while driving, and 14 states ban handheld devices. We see drivers everyday with cell phone in hand, either talking or texting while operating a motor vehicle. The bill would require the vehicle operator to pull over and be completely off the road in order to hold or touch a phone. The Mass bill would also make it illegal to access social media, video calls, or camera functions, or manually input data, such as to a GPS system, while driving. Exceptions would be made for a single swipe to activate hands-free functions or for certain emergency calls if there is no one else in the vehicle able to make the call.

file0001137628004-225x300Every year, thousands of children are seriously injured or killed in backover accidents, where a driver backs up their vehicle and doesn’t see the child. On average, there are 232 deaths and 13,000 injuries due to backovers every year. Beginning next May 2018, the National Highway Traffic Safety Administration (NHTSA) will require mandatory backup cameras on all new model vehicles. The finalized requirement has been in the works for many years after much deliberation. This is reassuring to many including the car accident attorneys at Tapalian Law as we hear too often of backover accidents, which occur when a driver backs over another person without noticing- usually in a driveway or parking lot. Being smaller in stature, children are all too often the victims of these tragic accidents. In over 70% of these incidents, a parent or close relative is the driver of the vehicle. With this new regulation going into effect, it should make great strides in preventing injury and death in these types of accidents.

Children Most Common Victims in Backover Accidents

Kidsandcars.org, an organization that brings awareness to child and auto related tragedies, reports that 50 children are backed over every week in the United States because a driver could not see them. Children under age five are the most at risk and the most common age of those hurt or killed in backover incidents is one year old. These numbers are astounding and tragic. Over 60% of the backovers involve a truck, SUV, or van. Just this past weekend a toddler in Bristol, Connecticut was killed when the child’s father was moving a vehicle in the driveway. A Providence toddler was killed in 2014 when a neighbor unknowingly backed over the child while backing out of her driveway. The following month, a Barrington woman was killed when a young family member accidentally accelerated while backing up in the driveway.

Mothers Against Drunk Driving partnered together with Uber in a recent research study in order to examine the implications of the surge and popularity for ride sharing services. Ride-sharing services like Uber and Lyft have heavily promoted their benefit of allowing individuals to contact someone to provide a ride when they are under the influence. Uber has experienced a surge in popularity since the service first became available. Since then, it has expanded into numerous cities and made it easier than ever to call someone to pick you up, whether you’ve been drinking or whether you just need a lift home.

This keeps individuals from getting behind the wheel of their own car and potentially injuring others. Uber recently released data on their impact in Atlanta as it relates to drunk driving. Since their introduction in the Atlanta area in 2012, Uber has experienced consistent growth and has around 583,000 active riders and more than 19,000 active drivers.

The Atlanta Police Department examined DUI arrests data to determine how beneficial or disadvantageous the ride-sharing service was for DUI arrests in drunk driving accidents.
